Why Would SCOTUS Take Up Trump’s Phony Immunity Claim?

I don’t know how many of our shared blogging community follow Steve.  I have followed him for what seems a long time, through three blogs of my own.   I started following him for his atheist content but have he has a great take on other topics.  I strongly recommend following his blog.    Hugs.  Scottie

  1. I think they had to take it up once states began disallowing his name on their ballots. It will finally put to rest that fake immunity claim. their is no immunity for a sitting president otherwise the 14th amendment would not exist….and it would take 2/3 of the states to ratify the 14th being taken away.

    1. Hi Suze. I agree they had to take up the ballot issue. Even though it seems clear to me and the court has always used the idea that states run their own elections to look the other way on gerrymandering and restrictive voting laws. So if they rule against the states they will have to tie themselves up in knots.

      However the immunity issue is a different thing. They already rejected taking it up from both tRump and the special prosecutor. So why do it now, and why take two weeks to do so? That it took two weeks means they had three justices for taking up the case, and those three were desperately trying to get a fourth. Plus did you notice the case they are taking up was not the one they were asked to decide, something that according to the rules they are not supposed to be able to do but it is what they did in the Dobbs case that ended the right of 50 years for abortion. The question that they were asked to settle was did a president have immunity for illegal acts while in office or once out of office. The order they put out accepting the case said they were deciding if presidents have immunity for legal presidential actions while in office.

      The result is a massive delay of the trial. First for this but then even after they rule as tRump’s is accused of illegal actions as president and after leaving office the entire thing will go through a series of appeals again. That means this case could take years now, instead of being over before the election. Plus if tRump wins, he will dump all the federal cases and he will force the states to drop theirs by threatening to deny them any federal moneys for anything. Hugs. Scottie
