The way Gay-Straight Alliances (GSAs) won the right to meet in schools is through the federal Equal Access Act (EAA) of 1984. Any school that permits non-curriculum related student groups must provide equal access to all student groups, and that includes equal access for GSAs. I’m no lawyer, but I wonder if this law can be used in this way.

Marching into a gay bar to issue citations feels a bit vintage in 2024. Nevertheless, over the weekend, the Joint Enforcement Team (JET), which is a coalition of Seattle Police, Fire, the state Liquor and Cannabis Board (LCB), and others, entered two gay bars, The Cuff Complex and The Seattle Eagle, and started looking around.
And what did they find? A bartenderβs exposed nipple and a few people wearing jockstraps, offenses that law enforcement can cite you for in Washington if youβre also selling alcohol.
At 12:30 on Saturday morning, a 10-member JET crew filed into Cuff, according to owner Joey Burgess. They came in with flashlights, scaring some patrons who left in a hurry. Inside, they saw the offending nipple, a violation of state law the JET may penalize in some way.
A group of Capitol Hill gay bars and clubs are teaming up with neighborhood queer community leaders Dan Savage and Terry Miller in calling for the stateβs liquor control board and Seattle Police officials to explain what they say was a weekend crackdown reminiscent of historical harassment of Seattleβs LGBTQ friendly venues.
Ownership at the bars including The Cuff, Queer/Bar, Massive, and The Eagle along with Savage and Miller say that citations issued over weekend over clothing and decency violations at a handful of clubs recorded by the Washington State Liquor and Cannabis Board and so-called Joint Enforcement Team inspectors were targeted.
The group is asking for the community to demand the liquor control board explain its actions.

I used to have a lot of respect for the police. In the past 12-15 years, that has really eroded away. When I see the times they have shot people because they felt threatened by somebody sitting in a car or reading that the person was shot 56 times, I question them. A new rule proposed by the Biden Administration would protect LGBTQ+ youth in the foster care system by requiring adoption agencies to place them in homes that affirm their sexual orientations and gender identities. Republicans, however, have come out in opposition to the change.

Lawmakers in both the Missouri House of Representatives and Senate debated a total of eight anti-transgender bills in a single day this week.
The measures, affecting trans peopleβs ability to access healthcare, bathrooms, and other facilities, and legal recognition of their gender identity, represent just a fraction of theΒ 49 anti-trans billsΒ Missouri Republicans have already introduced this month. Trans journalistΒ Erin Reed describedΒ the latest wave of proposed laws as βa firehose of legislation that touches every aspect of trans peopleβs lives.β
State law allows the university to provide gender-affirming care, but it still refuses to do so.
On Wednesday, Missouriβs Senate Education and Workforce Development Committee heard testimony onΒ S.B. 728, one of two bills, which would establish a βParentsβ Bill of Rightsβ in the state. Among other provisions affecting school curriculum, S.B. 728 βprohibits public school officials from encouraging a student under the age of eighteen years old to adopt a gender identity or sexual orientation.β It also requires school officials to βinform a studentβs parent within twenty-four hours if the student expresses confusion about their documented identity or requests to use personalΒ pronounsΒ that differ from their documented identityβ and to βobtain written parental consent before allowing a student to use a name other than the name provided by the parent when registering the student for school and before encouraging a student to wear certain items of clothing.β
Effectively, the bill requires schools to out suspected trans and nonbinary students to their parents.
The committee was also scheduled to hearΒ S.B. 770, another βParentsβ Bill of Rightsβ measure that included a ban on transgender girls participating in school-sponsored girlsβ athletic teams. The hearing on S.B. 770 was canceled, however.
Meanwhile, in a nine-hour hearing, the stateβs House Emerging Issues Committee took up seven separate anti-trans measures.
Two bills sponsored by Missouri state Rep. Brad Hudson (R) target access to gender-affirming healthcare.Β H.B. 1519 would allow healthcare professionalsβincluding, as Reed noted, pharmacists, desk workers, and nursesβto refuse to treat trans people receiving gender-affirming care. During public testimony, opponents of the bill noted that it would not only legalize discrimination but could also result in cisgender, nonbinary, and intersex people being denied medication by providers who mistakenly assume they are trying to access gender-affirming treatment.

HudsonβsΒ H.B. 1520, meanwhile, aims to strengthen and extend Missouriβs βSave Adolescents from Experimentation (SAFE) Act.βΒ Signed by Gov. Mike Parson (R) last June, the law banned all gender-affirming care for minors but included an exception for trans young people who are already receiving such care, as well as a sunset provision, causing the law to expire in August 2027. H.B. 1520 would remove those provisions, forcing trans minors who are currently receiving gender-affirming care to detransition and extending the law beyond the 2027 expiration date.
State Rep. Ashley Aune (D) noted that the sunset provision was included in the SAFE Act so that lawmakers could assess the lawβs βunintended consequences.β Hudson responded that there is already βenough evidence out thereβ and that he knows βthese drugs are not good for kids.β
In fact, every major American medical association has acknowledged that gender-affirming care, including puberty blockers and hormone therapy, is evidence-based, safe, and effective for the treatment of gender dysphoria.
The committee also heard testimony on four bills aimed at banning transgender Missourians from using bathrooms and locker rooms that correspond to their gender identity. Proponents of such laws almost universally focus, without evidence, on the supposed threat transgender women pose to cis women in public restrooms. But during Wednesdayβs hearing, opponents noted that, far from alleviating any discomfort, the bills would force masculine-presenting trans men to use womenβs restrooms and also endanger trans women forced to use menβs facilities while doing nothing to prevent actual predators from accessing womenβs bathrooms.

Rep Aune: "In a situation where you are in public, if a law went into place that required you to use the restroom as defined in this bill, would that leave you using women's restrooms?"
Additionally, one of the bathroom bills introduced by state Rep. Adam Schnelting (R),Β H.B. 2308, would legally define the terms βmaleβ and βfemaleβ according to a personβs reproductive biology.
Similarly,Β H.B. 2309, also introduced by Schnelting, aims to legally redefine βgenderβ as synonymous with biological sex. According to Reed, the bill would end any legal recognition of transgender people in the state and would likely affect the gender markers on their birth certificates, driverβs licenses, and other forms of ID.
Schnelting testifiedΒ that his bills would affect βbathrooms, dorms, shelters, everythingβ and might even βnullify sex-specific scholarshipsβ given to trans individuals.
Democrats on the committee blasted their Republican colleaguesβ seemingly single-minded focus on limiting the rights of transgender Missourians. State Rep. David Tyson Smith (D), who noted that Republicans make up 40 percent of his constituents, argued that people want lawmakers to address βinflation, grocery store prices.β
βPeople are wondering why we are spending time on this,βΒ Smith said.
State Rep. Doug Mann (D) sounded an even more urgent alarm. βWhen it became no longer acceptable to be anti-gay in public, people moved to being anti-trans,βΒ he said. βWhen you start to attack an already vulnerable group of people, you do not stop with that already vulnerable group of people.β
βIβm going to be honest, I do not trust that this is the end,βΒ Mann said of the anti-trans bills. βEverything I have seen as a student of history, as a student from politics, as a student of government, tells me that it is going to go farther. Things are going to get worse, not better.β

A Northeast Florida lawmaker wants to legally define the words βmanβ and βwomanβ based on biological sex at birth. Jacksonville Rep. Dean Black filed the proposed What Is A Woman Act this week, which would also impose new requirements related to transgender individuals on state agencies and insurance companies.
House Bill 1233 requires state agencies to revoke any identification cards, like driverβs licenses, that donβt match up with a personβs sex on their birth certificate.

Blackβs bill would also require any health insurance policy in the state that covers transition-related βprescriptions or proceduresββ to also cover βtreatment to detransitionβ from such procedures.
It would also require coverage of so-called conversion therapy by requiring health insurance policies to cover mental health services βto treat a personβs perception that his or her sex is inconsistent with the personβs sex at birthβ by affirming their birth sex.
The bill would also require any school district or state agency βthat collects vital statistics for the purpose of complying with anti-discrimination laws or for the purpose of gathering accurate public health, crime, economic, or other dataβ to identify the birth sex of people in the data set, potentially restricting data collection on trans people.

Take out all urinals. Put in stalls. Make every bathroom unisex. That way, men will have to wait in line just like women do now. (I went to a football game where they had port-a-potties while they were building the bathrooms. Port-a-potties, of course, are unisex. But there was one that was for women only, and of course I waited in that line for it. The other ones wereΒ disgusting.

I wouldn’t be surprised if someday that red states require a mandatory genital’s check to make certain that you are male or female per their standards on gender and ID. Sigh.
