FL House Approves Expanded K-8 “Don’t Say Gay” Bill

The wide-ranging bill (HB 1069) also seeks to restrict the way teachers and students can use preferred pronouns in schools and bolsters a process for people to object to instructional materials and school-library books.

 

It also expands school board jurisdiction to classroom libraries. The bill would allow a parent who disagrees with a district’s ruling on a book challenge to appeal the state education commissioner to appoint a special magistrate to hear the dispute.

“This bill has given a ticket for racist, homophobic people — that this chamber does not support – to pull books that matter to our children,” said state Rep. Robin Bartleman (D-Weston).

And in about a month, they’ll expand it yet again to all grades and start looking for ways they can force their anti-LGBTQ pogrom on colleges and universities.

Their ultimate goal is to get rid of everything gay.
That includes but is not limited to Marriage Equality.

Idaho GOP Votes To Criminalize “Abortion Trafficking”

This is the first time that a state has put a law on the books that restricts its residents from interstate travel for abortion access. Idaho already has a near-total abortion ban in place. Neighboring Washington and Oregon allow minors to get an abortion without their parent’s consent.

Idaho’s HB 242 would imprison for up to five years any adult who accompanies a minor across out-of-state without a parent’s consent — an action that the bill calls “abortion trafficking.”

I heard last night on MSNBC that Obstetricians are leaving Idaho. Soon there will not be doctors to deliver babies in the state. It seems that doctors were not without alternatives in front of a maniacal state government.

 

Correct. Its happening in multiple states. First, blue states have a surge in demand so can offer higher pay. Second, treatment of legit miscarriages could cause an a doctor to be subject to police investigation or worse. The maternal death rate in red states (already higher than blue states) is going to skyrocket.

 

My daughter is an OBGYN in Georgia. She calls me and tells me terrifying and gory stories of things that happen on occasion, sometimes to young and perfectly healthy women, in the delivery room. Sometimes even the most skilled doctors have to hit the panic button and summon in a specialist because things can go terribly wrong in a fraction of a moment, even under the best of circumstances.
Imagine now what will happen when the doctors have fled from the red states and there are not enough to go around to save the lives of these mothers and forced mothers to be? I get a chill when I think about it.
What a terrifying time it is to be a girl/woman.

 

Frightening as hell. I image we will see an intra-country medical tourism where wealthy women will travel to blue states to spend there last few pregnant months near a hospital capable of delivering competent care.

 

…and poor women and girls will die in horrifying circumstances that could have been prevented but for the red state policies being put in place.

Republicans want to knock girls up and then hold them prisoner as breeding ovens in their shithole states.

It’s starts with “protecting the kids” to “we know what’s best for our women.” I’ve heard arguments that “the unborn are our state’s citizens, and we have the right to safeguard them.” How women and any men who love them aren’t outraged & unleashing hell upon their would-be captors stuns me to no end.

Texas Judge Strikes Down Insurance Coverage For PrEP

 

The suit was brought by extremist anti-LGBTQ activist Steven Hotze [photo], who was recently ejected from a Texas Senate hearing after repeatedly calling transgender people “pedophiles.”

Hotze appeared on JMG in September 2022 when he explained how COVID vaccines are designed to connect people to the internet “so you can be mind-controlled by artificial intelligence.”

In April 2022, Hotze was charged with two felonies related to a bizarre 2020 “voter fraud search” incident.

Hotze appeared on JMG that year when he left a voice mail for Texas Gov. Greg Abbott, telling him to “shoot to kill” Black Lives Matter activists.

You may recall that Steven Hotze has compared gays to “communist termites” eating away at America’s moral fabric. He is also fond of declaring that it’s now a hate crime to denounce homosexuality.

It was Hotze who bankrolled the successful campaign to repeal Houston’s “wicked, evil, Satanic” LGBT rights ordinance, during which he compared gays to rapists and murderers.

According to Hotze, same-sex marriage will result in children “practicing sodomy” in kindergarten.

In 2017, he appeared here when he “prophesied” that God will deliver “just retribution” to lawmakers who vote for LGBT rights.

When he’s not calling on God to kill politicians or for the governor to kill Black Lives Matter activists, Hotze sells “miracle” supplements because high cholesterol doesn’t really cause heart disease.

Hotze regularly quotes QAnon slogans.

O’Connor has widely been described as conservative. O’Connor has become a “go-to” favorite for conservative lawyers, as he tends to reliably rule against Democratic policies. Attorneys General in Texas appear to strategically file cases in O’Connor’s jurisdiction so that he will hear them.

1 in 5 American Trans Kids Live in States That Have Passed Bans on Gender-Affirming Care

Though the full human impact of the current legislative assault on trans existence can never be quantified, a new analysis from the Human Rights Campaign shows its magnitude. According to new statistics from the LGBTQ+ organization, more than one-fifth of trans youth live in states that have passed bans on gender-affirming care for minors. 

On Wednesday, HRC released a new map outlining attacks on gender-affirming care by state alongside a new report with information pulled from the organization’s own legislative tracking. The report also drew from data compiled by the Williams Institute at the UCLA School of Law showing that there are more than 300,000 trans youth aged 13-17 in the United States. The map also illustrates which states have already banned gender-affirming care for minors and which are currently considering laws or policies to do so. 

According to the report, 22.9% of trans youth live in states that have passed bans on gender-affirming care for minors, a list that includes Arizona, Utah, Texas, South Dakota, Iowa, Arkansas, Mississippi, Tennessee, Alabama, and Florida. In three states — Alabama, Arkansas, and Texas — temporary court injunctions are currently blocking those bans. In addition to youth living in states that have already passed bans on gender-affirming care a further 27.5% of trans youth are at risk of losing access. 

 

Combined, over half of trans youth (50.4%) live in states where they’ve already lost access to or are at risk of losing access to gender-affirming care, according to the HRC report. However, as ACLU communications strategist Gillian Branstetter pointed out on Twitter, this statistic accounts for every state that has a proposed ban, even though many of those bills will likely never pass into law. According to a separate report by HRC, 91% of the anti-LGBTQ+ bills introduced in 2022 failed to become law. 

However, that doesn’t change the fact that the mere introduction of these bills profoundly impacts LGBTQ+ people, especially trans people. Jay Brown, senior vice president of HRC, stated that Republican politicians “are spreading propaganda and creating more stigma, discrimination, and violence against transgender people just to rile up extreme members of their base.”

January report by the LGBTQ+ advocacy organization Trevor Project found that state-level anti-trans laws negatively affected the mental health of 86% of trans and nonbinary youth between ages 13 and 24. 

“LGBTQ+ people are living in a state of emergency,” Brown said in a press release. “Today’s findings illustrate how the ongoing assault against transgender people is taking hold across the country and underscore how dire the situation is growing for our community by the day. These dangerous and discriminatory policies advocated by power-hungry politicians are void of any credible purpose.”

A bakery will permanently close its doors after experiencing months of vicious harassment for hosting a drag show.

Uprising bakery & café is located in a Chicago suburb called Lake in the Hills and owned by Corinna Sac, who opened the bakery in 2021 as an inclusive space for all. A press release announcing the closing details Sac’s desire for the bakery to be a space where LGBTQ+ couples could come for wedding cakes.

“Her dream of an inclusive bakery has since become a nightmare no businessperson could have anticipated,” the release states.

“Closing our doors is the direct result of the horrific attacks, endless harassment, and unrelenting negative misinformation about our establishment in the last eight months,” Sac, who is bisexual, said in a statement. “From an award-winning bakery that donates to local organizations and supports diversity and inclusion, we have been rebranded by misinformation as ‘gay only’ and ‘pedophiles.’”

She added that the relentless protestors have caused local customers to be afraid to visit the bakery out of fear of harassment.

The press release describes the event in question as a “family friendly show featuring drag performers” that was hosted by the café in 2022 and required registration and a ticket.

“The event drew outrage from many resulting in a targeted attack of vandalism at the property the night before. The doors and windows were destroyed, the glass was shattered, and messages of hate were painted on the building.”

Sac said the man who did this, Joseph Collins, was a member of the white nationalist hate group Proud Boys and was charged with a hate crime.

After more attacks took place, the Village of Lake in the Hills then told Sac she could no longer hold events in the space due to zoning, even though she’d already been hosting events there for a year with no issues.

“A campaign was initiated to discredit, damage and defame Ms Sac, her staff, her food, and her patrons,” the press release went on. “Protestors spent more than 120 consecutive days on the property, creating disturbances, inciting violence, photographing license plates of patrons, and harassing them on social media and online.

Because patrons have been too intimated to visit the bakery, Sac’s sales have plummeted and thus, she cannot afford to stay open. She said she’d need $30,000 to keep her doors open.

Sac is currently working to raise money for employees so she can give them some financial padding. There are also events and fundraisers scheduled throughout the rest of the month to try to save the bakery. If they do not succeed, it will close on March 31st.

“Everything I have is in this business,” Sac said. “Our home, our cars, retirement, savings. We put everything we had on the line and personally secured this location, our equipment, and our dreams.”

No matter what happens, Sac vowed never to stop fighting for justice. She recently testified at the state legislature about her experiences.

“If we have to go out, we will go out with a BANG,” she declared in the release, “and make it long-lasting and positive. I will do everything I can to make sure what happened to my American Dream doesn’t happen to anyone else.”

Fueled by anti-LGBTQ+ misinformation on social media, over the past year, drag queen story hours and other family friendly LGBTQ+ events featuring drag performers have become a target for far-right groups like the Proud Boys as well Republican politicians. Earlier this month, Tennessee became the first state to pass a law intended to ban drag performances in public spaces. Similar legislation has been introduced in state houses across the country.

So are the LGBTQ+ adults.  DeathSantis and his maga sycophants have painted target signs on each of us and his violent gang thug enforcers along with the recharged up fundamentalist religious people who feel they have the right to oppress everyone into forcing them to live by the dictates of their religion are making the lives of queer people in Florida miserable.  They keep pushing harder and harder to make their way the only way to live.   What is acceptable to them is the only acceptable public expression.   This is about not allowing any other social public expression than what their church allows them according to their outdated 1950s strict gender role model based on the idea that white Christian men are automatically in charge and women are subservient to them while minorities know their place and stay there.   All according to the white males in charge who like it that way.  And they use a set of mistranslated writings from 2,500 years ago to back up their demands.   I want you to pay attention to what the student says is happening on high school campuses, where conserative right wing teachers / administrators design polices and punishments for queer kids while using those polices to protect themselves from repremand.   The student says she has seen teachers mock and out gay kids to parents and laugh about it.   Also kids who try to stand up for the queer kids have their own futures placed in jepardy as their transcripts get lost, documents they need lost, and even collage applications no longer approved, or loss recommendations made by the school if they don’t stop speaking out in support of queer kids.     Think of that, the change from the days when kids were encouraged to be active in cuases, in socail movements.    Hugs

Under Gov. Ron DeSantis (R), Florida has become a closely-watched epicenter for anti-LGBTQ+ laws – and advocates say queer youth are feeling the impact.

With the passage of sweeping anti-LGBTQ+ legislation, such as the Don’t Say Gay law, gender-affirming care bans, and bathroom restrictions, Florida has become a battleground for queer rights. DeSantis’s anti-LGBTQ+ rhetoric has continued to exacerbate the issue, leading to concerns among LGBTQ+ advocates that the state is becoming increasingly unwelcoming to queer youth.

“We’re terrified,” Christina Guiriba, a transgender youth advocate, told LGBTQ Nation. “As advocates for the community, we’re very torn. We want to continue this fight.” 

Guiriba is the founder of Transcending Adolescence, a Jacksonville-based nonprofit aimed at empowering trans youth.

A trans woman and Florida native who has experienced bullying and physical violence during her childhood, she leads a summer camp called Resilience Retreat for around a dozen trans youth to build their courage and resilience. She wants every participant to leave camp having defined success on their own terms, whether that be finally finding a safe space for the first time or going through with top surgery. 

“Seeing a staff full of gender-diverse people that are successful and still alive gave them hope,” she said. Through the power of the outdoors and physical recreation, she hopes to continue to be a voice for “those who are afraid.”

But Guiriba said that many advocates are afraid to continue their work as they find themselves the target of right-wing hate. Transcending Adolescence, in fact, was recently the victim of a doxing attack.

As a result, the organization was forced to adopt stricter security measures such as planning escape routes and installing surveillance cameras and panic buttons. They even hired a private security officer, unable to turn to the Jacksonville police due to their transphobic reputation, such as using deadnames in official police investigations, among other reasons. 

But Guiriba isn’t stopping. Her work is becoming increasingly relevant as new research shows how ongoing anti-LGBTQ+ attacks are starting to impact queer youth.

“The consequences are really more dire than even most people would imagine,” Caitlin Viccora, programs manager for healthy & supportive schools at Advocates for Youth, told LGBTQ Nation

A recent CDC report on youth behavior over the past decade shows record-high levels of depression and suicide risk among teenagers in recent years. The CDC’s Youth Risk Behavior Survey reveals that more than half of LGBTQ+ students have recently experienced declining mental health and more than one in five had a suicide attempt within the past year. Queer female adolescents fared worse compared to males. 

In Florida especially, Viccora said the priority for advocates is to set the record straight and clear the air of false information. Parents have a right to know what’s really happening in their child’s classroom without having to rely on the right-wing’s “targeted disinformation campaigns,” Viccora said.

“It’s not just Republicans who are failing to protect LGBTQ+ students,” she added, “A lot of folks are staying silent.” 

She urged community members to speak publicly at local school board meetings and fight proposed regulations that impact queer youth. Submitting public comments, organizing to call local officials such as superintendents, or just showing up to the polls to vote are effective ways to protect queer youth.  

Queer youth are learning to “shut up and keep their head low”

“Ron DeSantis is a terrifying man,” Iris, a high school senior in Clay County, Florida, who requested to use a different name out of fear of retaliation, told LGBTQ Nation. “[DeSantis] claims to be a Christian but at the basis of Christianity is acceptance and love. Yet he chooses violence and overall bigotry.”

Iris does not identify as queer, but her queer friends would not speak with LGBTQ Nation, citing safety concerns even if they remained anonymous. Instead, they spoke through Iris.

In her previous attempts to speak out, Iris said her school officials claimed to “lose” her documents, opening the possibility of preventing her from graduating high school. She said speaking out would even “jeopardize my college [applications].” 

Iris said Gov. DeSantis has created a “hostile environment” for Florida students that enables hatred and punishes those who try speaking out. She recounts an instance where a close male friend dressed as a PowerPuff Girl for Halloween and was viciously bullied during school hours. The bully received no penalty while Iris’ friend was reprimanded for several infractions, one of them being a dress code violation. 

In a second instance, she reports that her school principal outed numerous queer kids to their parents. She said the principal was even spotted laughing and mocking the list of students she outed with one of those students’ parents. 

This practice is becoming increasingly common across Florida schools, with school administrators developing formal policies to punish or out queer kids to their families. 

“Teachers are able to say and do things without consequence,” said Iris, noting that these types of policies serve to primarily protect conservative and right-wing educators.

She added that queer kids are learning that they need to “shut up and keep their head low” in order to survive. 

Both Guiriba and Viccora emphasize the importance of remaining positive, continuing their fight to ensure a brighter future for queer youth across the country. 

“It’s important for queer people to know they’re not alone,” said Guiriba, also stressing that advocates take the appropriate time to rest. “It’s not easy to find strength.” 

“Living as a queer person in America is really scary when you’re looking at headlines,” Viccora said, especially when queer Americans face discrimination and violence at every corner. Despite this, Viccora urges queer youth to remember the “beauty and resiliency” in the simple fact of our existence.

Arizona Schools Chief Launches Anti-Teacher Snitch Line

Over the last 50 years while the democrats pursued only the highest offices in the land the republicans were pushing hard to take over state government and the churches rushed to take over the school boards.  I remember that in the 1990s in Palm Beach Conty that the big churches were fielding stealth candidates to take over the boards and change what was being taught.  It was underway back then!  Now the right wing /maga republicans are using their complete control over the levers of state power to end right, roll back protections, to take the states back to a time of strict gender roles for the sexes and a time when minorities were second class citizens who either knew their place or they were not allowed in society in any way.  In fact they are not just trying to return society where gays were a shame to the family but they want a time when gays could be arrested along with denied working for any level of government being banned from security clearances.  They are driving hard for this.  Look at the red states trying hard to bring back banned conversion therapy that has been well and full debunked as not only something that doesn’t work but was found to be very harmful to those subjected to it.   They again want to deny the medical science because it shows their ideology is wrong.   Being gay or trans is not a choice, it is not a disease needing to change or cured.   People are born gay / trans and while some manage to hide it, they should have to.  They should be able to live their lives freely as they really are.   Plus now they want to set up secret hidden police where neighbor spys on each other and reports to hotlines those not following the party rule.    Hugs

Arizona schools chief Tom Horne has launched the Department of Education “Empower Hotline” so that Arizonans can report inappropriate public school lessons that detract from teaching academic standards.

These include those that focus on race or ethnicity, rather than individuals and merit, promoting gender ideology, social emotional learning, or inappropriate sexual content.

The hotline provides the opportunity for constituents to provide feedback, concerns or complaints, which is a standard service offered by multiple government agencies and private-sector businesses.

It is available at 602-771-3500, or through email at empower@azed.gov. The phone line will be staffed during normal business hours, but after-hours phone calls as well as emails will be accepted at any time and followed up appropriately.

Horne explained, “Some say critical race theory (CRT) is a graduate study, not taught in K-12 schools. The evidence is to the contrary. I have a list of 250 Arizona teachers who signed a shocking statement promoted by the national teachers’ union, that if critical race theory were banned, they would defy the law.

“They would not have signed if they were not already teaching it. They come from 25 school districts, including the largest ones. Teachers must teach academics, not use their power over a captive audience, to promote their personal ideology. That is unprofessional conduct.”

Horne added, “I promised to establish this hotline so that anyone could report the teaching of inappropriate lessons that rob students of precious minutes of instruction time in core academic subjects such as reading, math, science, history and the arts. That promise is being kept.”

While Arizona state attorney general, Horne threatened to sue cities that recognized out-of-state same-sex marriages. That same year he proposed legislation allowing public school teachers to carry guns. Horne has faced multiple allegations of campaign finance crimes and has a lifetime trading ban by the Securities and Exchange Commission related to an investment firm he founded before running for public office. As you can see below, he is a supporter of QAnon freak show Vaseline Woman. 

 

Isn’t it odd that they think that they can actually change someone from being gay to being straight after months or years of therapy, but they also think an entire classroom of children will become gay after hearing a guy in a dress read them a story.
Fuck these people and their hatred of the LGBTQ community. They want to exterminate us. Ain’t gonna happen.

We need to lodge complaints in response to any lesson which mentions mommy/daddy, sister/brother, aunt/uncle, etc, as unnecessarily provocative.

This is just what Arizona needs for their teacher supply. It is a common belief among teachers around her that two places you don’t want to go teach is Colorado and Arizona. The pay and benefits are very low. This won’t help the state find teachers.

    Ultimately the attempts to ban certain women from sports is stupid, it’s the same logic that leads the Olympics to banning all three medalists in the 800 meter race from participating unless they take feminizing drugs.

    These medalists were all AFAB and identify as women.

    The Ohio legislature is contemplating banning trans folks from high school sports.

    The Ohio schools athletic association said there are 4 trans students (didn’t identify male or female) in the high school sport system. But only 2 would be playing any sport this year. Out of almost 500,000 high school students, the legislature is all about 2 of them. Wasting time about 2 students.

On the most recent episode of The Problem with Jon Stewart, the show’s namesake and host grilled an Ohio Republican, using his support of drag show bans to expose the hypocrisy behind his opposition to gun control legislation. A clip from the interview, which premiered on Friday, has since gone viral.

Oklahoma state Sen. Nathan Dahm (R) opposes restrictions on firearms, like laws requiring background checks and red-flag laws, because he says they infringe on a person’s Second Amendment rights. He also supports banning drag shows anywhere they might be viewed by minors.

During his interview with Dahm, Stewart clashed with the lawmaker over the idea that increased access to guns makes Americans safer, arguing that Dahm’s efforts to loosen gun restrictions have made it harder for authorities to identify individuals who may pose threats.

“The person is the threat, not the firearm,” Dahm explained.

“But you don’t want anything that could help law enforcement or society determine whether or not a person is a good guy with a gun or a bad guy with a gun,” Stewart countered. “I don’t understand why you won’t just admit that you are making it harder for police to manage the streets by allowing all of these guns to go out without permits, without checks, without background stuff.”

Dahm argued that the restrictions he opposes infringe upon “the individual’s right to keep and bear arms” under the Second Amendment.  

Stewart then pivoted to other examples of ways in which constitutional rights are limited under the law, including requiring voter registration. He then questioned Dahm about his support for an Oklahoma bill that would make it illegal to host drag performances on public property or where they could be viewed by minors. Similar bills are being considered in states across the country. Last week, Tennessee became the first state in which such legislation was signed into law.

Stewart asked Dahm whether Oklahoma’s anti-drag law would infringe on the First Amendment rights of performers. Dahm argued that under the proposed law, drag performers could continue to exercise their right to free speech, “just not in front of a child.”

“The government does have a responsibility in certain instances to protect children,” Dahm admitted.

“What’s the leading cause of death amongst children in this country?” Stewart asked. “And I’m going to give you a hint, it’s not drag show readings to children.”

“It’s firearms,” Stewart continued. “More than cancer, more than car accidents. And what you’re telling me is you don’t mind infringing free speech to protect children from this amorphous thing that you think of. But when it comes to children that have died you don’t give a flying f**k to stop that because that shall not be infringed. That is hypocrisy at its highest order.”

 

The clip has since received over 36,000 views on Twitter and more than 1.2 million views on YouTube.

I tried to group these articles in some sort of order.  But you can see the goals of the right just from the titles.   The eradication of transpeople at any age from society. The removal of any gay rights with the goal of eradicating gay people from society.  The enforcement of stereotypical gender roles and the returning to the days when women were dependent on men, and few had authority or independence on their own.  They want tyranny and dictatorship of one party rule with no restraint on their activities even to the point of attempting the overthrow of the US constitution / government and the celebration of those that committed the illegal acts in the coup attempt.    Republicans want to rule not govern, they want to have the people afraid to disagree with them or dare to speak against their rule.  Just like the countries of China, North Korea, and their beloved Russia.   Please notice the attempt is to return the US to the regressive oppressive times before the New Deal that empowered the public.   They want 1910 to 1920.  We had better join together to stop them or we won’t be able to.   DerSantis is shopping the campaign slogan “Make America Florida”.   Is that not enough of a threat to the country?   Has the trump years not shown how quickly the right can move if given power to destroy all norms and rights to enforce their minority rule.   McConnell even said that while republicans will lose elections the democrats couldn’t stop a republican stacked court system from enforcing republican goals for decades.  He was correct.  Mitch McConnell said, “My goal is to do everything we can for as long as we can to transform the federal judiciary, because everything else we do is transitory.”   Hugs

Read the comments on this to see how things used to be for families and kids before labor laws and government assistance were created. Kids younger than five working a full day in the farm fields. Again these bills are a way Christians can force their moral views on everyone, a way they get to rule on how every person gets to live their lives.   It gives these rabid fundamentalists Christian republican groups the right to tell everyone else what they can do, regulating what everyone can watch / read in order to conform to a strict religious view of morality written 2,500 years ago.  It ignores all medical, scientific, and social advances done in the years since their holy books were written and mistranslated.   Society has advanced as human understandings have, yet these oppressive regressive people want to ignore all that.  Would they also like to go back to the medical understandings in the 1600s, 1700s, or even what was known medically in 1900.  That was 28 years before penicillin was discovered.  21 years before insulin was discovered.   Tell me if their holy book written knew everything about morals why did it support slavery?   Do we return to that also to please Christian fascists?  This is an attempt to enshrine a religious morality over everyone regardless of if you belong to that or any religion.   Again it is not about these people being able to live and act as they wish, it is about forcing everyone else to live by their church rules / doctrines.  Hugs

Bills are part of religious right’s post-Roe strategy, with most prevalent ones relating to age verification of sex-related websites

 

A wave of proposed legislation pushed by Republicans across the US at the state level is aimed at outlawing aspects of sexuality that could have a huge impact on Americans’ private lives and businesses.

Opponents to the laws before legislatures in various states say the planned new legislation could spawn prosecution of breast-pump companies in Texas for nipples on advertising, or a bookstore might be banned from selling romance novels in West Virginia, or South Carolina could imprison standup comics if a risqué joke is heard by a young person.

 
 

The bills are part of a post-Roe nationwide strategy by the religious wing of the Republican party, now that federal abortion rights have fallen. They range from banning all businesses that sell sex-related goods to anti-drag queen bills. Tyler Dees, an Arkansas state senator who wrote an anti-porn bill said: “I would love to outlaw it all,” referring to porn.

The most prevalent bills relate to age verification of sex-related websites. Seventeen states drafted porn age-verification bills, many inspired by Louisiana’s law that went into effect in January. Louisiana’s law requires websites featuring 33.33% or more pornographic content to check government-issued ID to verify users are 18 and older. Websites that don’t comply face civil penalties. Parents can sue the site if kids access it.

In Texas, a new bill requiring age verification on websites with pornographic content defines images of the female breast “below the top of the areola” as porn, potentially hitting at business advertisements. In West Virginia, a bill outlawing all sexually oriented businesses is on the docket, with a definition that includes art studios with nude models and wrestling arenas. In South Carolina a bill would criminalize using “profane language” related to “sexual or excretory organs or activities” in front of minors during performances. The punishment? Up to a decade in prison.

Some bills define porn so broadly that anatomy textbooks or sex education websites would meet them.

“I don’t think such laws for the internet are constitutional,” said Eugene Volokh, a professor of Law at UCLA.

Laurie Schlegel, a Republican state senator who drafted the Louisiana law, is a sex-addiction therapist educated at Baptist seminary, who opposed transgender students from being on sports teams that align with their gender. Schlegel’s anti-LGBTQ+ views fit with the broader goal of the laws, according to Carolyn Bronstein, a professor of media studies at DePaul University.

“These laws are really not about controlling minors’ access to violent pornography … In the conservative world view, pornography is information about LGBTQ identity, abortion, gay marriage,” said Bronstein.

Eight states have justified their actions by saying that porn is “creating a public health crisis”. Louisiana’s bill claims that pornography “may lead to low self-esteem, body image disorders, an increase in problematic sexual activity at younger ages … impact brain development … shape deviant sexual arousal, and lead to difficulty in forming or maintaining positive, intimate relationships, as well as promoting problematic or harmful sexual behaviors and addiction.”

Historian Whitney Strub, an associate professor of history at Rutgers University, doesn’t think these ideas are well-founded. “Framing pornography as a public health crisis is not driven by serious engagement with the social scientific literature,” he said. “They’ve even got fake peer-reviewed journals that give the imprimatur of scholarship … It’s been a very smart rebranding of evangelical Christian conservatism.”

Why are all these bills being proposed now? Strub thinks it’s partly because of the overturning of Roe v Wade“Abortion gave a certain coherence to conservative politics in the United States. And it certainly still does … but they’re in the position of Ahab if he slayed the white whale … I mean, there’s no more Moby-Dick.”

There is hypocrisy on display also.

In many of the states where the anti-porn bills are being put forth, minors can legally have sex and get married. “In Louisiana, you can have sex when you’re 17 with a person in their 30s, but you can’t watch porn,” said Jason Kelley, associate director of digital strategy for the Electronic Frontier Foundation.

In Mississippi, Arkansas and Louisiana, the age of consent is 16. With parental permission, Mississippi allows 15-year-olds to marry, Louisiana 16-year-olds, Arkansas 17-year-olds, and West Virginia kids of any age.

Dees, who wrote Arkansas’s age verification bill, a copycat of Louisiana’s, said porn causes depression and anxiety, divorce and “permissive sexual attitudes” and infidelity. “When I think about the children … I want to protect their innocence,” Dees said.

Strub said this is an old trope: “The political figure of the innocent and imperiled child just has a never-ending purchase on American politics … [it] essentially shuts down debate because it immediately creates a binary in which anybody who disagrees with you is [a] perverted groomer.”

Dees is also the co-author of anti-drag queen legislation in Arkansas, that classifies drag performances as the same category as pornography. “It’s not really a meaningful distinction to [conservatives]. They’re both sexual degeneracy in its different guises,” Strub said.

Dees claimed that his porn verification law “doesn’t have anything to do with any political messaging. It has to do with exposure to material that is harmful, period … There’s a clear enemy in the smut-peddling garbage that’s online.”

But measures already exist to prevent children accessing porn. “There’s a really easy way to keep kids from accessing adult content. And that’s a device-level filter” on mobile phones that block adult websites that are registered as Restricted to Adults, said Mike Stabile of the Free Speech Coalition, which advocates for the rights of sex workers.

These laws, according to Stabile, aren’t going to stop kids from looking at porn. “Even if they were to block all sites, you’re still going to have adult content on Twitter and Reddit … kids will get VPNs,” he said.

Stabile thinks we’ll see up to two dozen age-verification bills introduced by the end of the year.

Dees hopes he is right and has eyes beyond the state level eventually. “My prayer is that enough states continue to push for this measure, and that we send a loud enough message where federal law can be put into place,” he said.
