Yes, 1937 or so. Towards the end of the “gilded age”, the SCOTUS was as virulently anti-decency as Alito and Thomas are now. FDR, then president, make a threat to “pack” (unfvck) the court and the court suddenly changed its tune on what the law was. Then the plan to fix the court fell apart.

There’s some suggestion that a similar thing may have happened between last term and this one with regard to KNAW, Roberts and Raspberry Baret. They have not gone along with the same degree of YOLO-ALITO that marked last year / the Dobbs Term.

I had a home in a small town for nearly 30 years. It had a small library, maybe twice the size of the one in my high school. The “Christians” would come in and check out ALL the non-Christian religious books and never return them. It was their way of making sure people couldn’t learn about other religions. And this was before Trump and the MAGA folks.
If your religion of “Christianity” is SO GREAT, it should be able to prove itself against the others by its merits and ideals, not by making the beliefs of others unobtainable.

Legal As Of Today In Florida: Bathroom Bill, K-8 “Don’t Say Gay,” Refusal Of LGBTQ Patients, Concealed Carry

A recap of what’s legal as of today in DeSantis’s Florida:

In public facilities, including prisons and schools, a new requirement will go into place requiring designated bathrooms for men and women, and individuals will be required to utilize facilities based on their gender as assigned at birth. It has no exceptions even for those who have fully transitioned through gender-reassignment surgery.

The Board of Education has already effectively expanded through high school a prohibition of instruction about sexual orientation or gender identity. A new law (SB 1069) codifies that at least through 8th grade. The legislation also prohibits any requirement that school officials use preferred pronouns that don’t match gender assigned at birth.

Health care providers can now turn patients away and refuse treatment based on “conscience-based objections.” DeSantis signed the new law (SB 1580) in front of a “Prescribe Freedom” sign and said it empowers physicians to act within their own morals. LGBTQ advocates label it a right to discriminate bill against gay and transgender Floridians, and the latter group has already seen restrictions on health care put into place this year by statute and the Board of Medicine.

Also going into effect today is the right to carry a concealed weapon without any permit or training, the right of hospitals to refuse care to undocumented patients, and a law allowing the state to use radioactive fertilizer byproducts in the creation of roads. That last one came about due to lobbying by the phosphate industry, which in 2021 saw a leakage of their toxic byproducts into Tampa Bay.

 

I hurt. Mentally, emotionally, physically.

This month has been hard.  Sudden large medical bills of $1,200, the information that we were too late getting our stuff to FEMA so the rest of the $37,000 dollars in repairs we have to pay for we have to fund, the $500 dollars to get the battery replaced in the car, my stress test during which I had my blood sugar crash and during the induced chemical part of the test I couldn’t breathe that left me shaken for two day.   Bad mightmares and intrusive thoughts / memories I don’t want to remember.   And so much more.   Ron says I may need to talk to someone again, you know therapy, but I am just not ready.   As the song says

I wrote this a day or two ago, but did not post it.   I do that a lot with personal post, especially when I am down or really upset.  Just writing about it helps me emotionally and mentally.   It is why sometimes I write about my abuse, it is my way of dealing with it.  The weird thing is when someone else is hurting and I can help, it helps me when I help them.   You would think it would be the other way round and just add more burden, but it doesn’t.  Somewhere I read a burden shared is a burden lessened.   So as I post this I want to add what I found out about the song.  I included the responces / comments to show the songs impact.   Best wishes, and Hugs.  Scottie

Meaning of “Everybody Hurts” by R.E.M.

Simply put, R.E.M.’s “Everybody Hurts” is designed to prevent people from taking their own lives. In 2003, co-writer Peter Buck of R.E.M. had stated that its lyrical simplicity is founded in the fact that the track is “aimed at teenagers”. However, it should be noted, in contrast, that the cover art for “Everybody Hurts” features a man who is clearly a senior citizen. Or, as Buck later stated in 2005, this song has “tended to work for people of a lot of ages”.

 
 
 

But apparently R.E.M. wanted young listeners in particular who may be suffering from serious depression to identify with the song and take a different route as opposed to possibly self-harm. And the argument the band uses is that “everybody hurts”. In other words, the targeted audience is not alone in their suffering. In fact being discontent with the way things are going is something that we all go through at times. So instead of doing something extreme, they should “hold on”, as in not give up on life. And one particular remedy the band espouses is for such individuals to “take comfort in (their) friends”.

On 7 February 2010, a collection of stars including Mariah Carey, Miley Cyrus and Jon Bon Jovi released a joint rendition of “Everybody Hurts”. This rendition was released under the collective named Helping Haiti to collect aid to be sent to that country in light of an earthquake it experienced during that year.  And R.E.M. waived the royalties they would receive from the money it generated in the name of that cause.

Music superstars P!nk and Kelly Clarkson covered “Everybody Hurts” to open the 2017 American Music Awards. They sung it in honor of America’s first responders (i.e. emergency workers) who were active during highly-publicized tragedies the nation was going through around that time.

 

President Donald Trump’s use of the song

“Everybody Hurts” has maintained a permanent presence in American pop culture. However, the track really caught the public’s attention in February of 2019 when US President Donald Trump used a meme created to mock his political opponents (i.e. the Democrats) which used the song.  In response, R.E.M. – and particularly Mike Mills in particular – really let the President know that they didn’t support this decision and indeed are not supporters of him as a “world leader”.  In fact they had Twitter remove the video on 16 February 2019, the day after it was posted, citing copyright infringement.

    I have attempted suicide twice, once I came very close. I now make sure I listen to this song when my demons catch up with me. It seems strange that a song can have such a powerful effect on a persons thoughts, but so do love songs, driving songs etc. But either way, I am thankful for the song and hope it has saved lives all over the planet.

    I really like the song and I’m thankful that they tried to prevent suicide and/or self harm with it but, being a person with suicidal tendencies I have two things to say about this son: the music extremely sad and whenever I listen to it it have the opposite effect on me, bringing all the bad memories of my past and I have to change the station. The second thing is that you can’t simply say “everybody hurts” to someone on the edge of talking their own life: depression makes you see a very narrow world and, somehow makes you not care about anyone else (if you could think about other people around you, you would never try to taking your own life). It’s a beautiful song and the intention behind it is good… but I wouldn’t suggest anyone with suicidal thoughts listening to this song in that particular moment.

A Massachusetts woman claims that an anti-abortion crisis pregnancy center failed to diagnose her ectopic pregnancy during an ultrasound appointment and that the pregnancy later ruptured, requiring emergency surgery to remove one of her fallopian tubes. Ectopic pregnancies are never viable and can be life-threatening; the pregnancy should have been terminated immediately.

The woman, known as Jane Doe, filed a class action lawsuit on Thursday in Worcester Superior Court alleging that Clearway Clinic in Worcester didn’t follow standard medical care. The suit also claims that Clearway engages in deceptive practices to lure in people seeking the full range of pregnancy options, when its actual purpose is just to dissuade them from getting abortions.

According to a press release, Doe thought she might be pregnant in October 2022 and wanted to get an ultrasound. She found Clearway through an online search and got an appointment later that day. A Clearway nurse did an ultrasound and said the pregnancy was both viable and in her uterus; the suit says it’s against state medical regulations for registered nurses to read ultrasounds because they’re not licensed diagnosticians. A physician didn’t see Doe, though her discharge paperwork said a medical doctor provided her care.

A month later, Doe felt shooting pain on her side and was so weak and lightheaded that her husband called 911, per the release. Emergency room doctors diagnosed her with a ruptured ectopic pregnancy and internal hemorrhage. In order to stop the hemorrhaging, doctors did emergency surgery in which they had to remove of one of her fallopian tubes. None of this should have been necessary, as legitimate medical providers would have ended Doe’s life-threatening pregnancy with medication—typically the cancer drug methotrexate.

Jezebel contacted Clearway for comment and didn’t hear back by publication time. CEO Jill Jorgensen said in a statement to Mass Live, “We cannot speak as to any individual’s medical claims or history due to HIPAA regulations.” She added that Clearway hadn’t faced an allegation like this in its more than 20 years of operation.

Crisis pregnancy centers, or anti-abortion centers, already receive millions in state funds, and many lawmakers are trying to increase funding after the Supreme Court’s Dobbs decision. Many CPCs don’t employ medical professionals, but still have their staff perform dubious ultrasounds. They’ve also been known to mislead people by saying their pregnancies are less far along than they really are so they run out of time to get an abortion. CPCs using non-medical staff aren’t bound by the medical privacy law HIPAA. While this particular facility appears to have employed healthcare workers, they didn’t adhere to medical standards.

The woman’s attorney, Shannon Liss-Riordan, called Clearway’s actions “not only illegal, but abhorrent” in a statement. “Our client was forced to undergo a traumatic, dangerous, and completely avoidable emergency surgery to save her life because she was deceived into going to an anti-abortion clinic instead of an appropriate healthcare provider,” Liss-Riordan said. “At every step of the way, she was led to believe she was receiving appropriate medical care when in fact she was subject to a campaign of misinformation and unfair and deceptive practices.”

The Massachusetts-based group Reproductive Equity Now said anti-abortion centers outnumber real abortion clinics in the state by three to one. That figure is about the same nationally, but the ratio is often higher in Republican-controlled states.

Rebecca Hart Holder, president of Reproductive Equity Now, said in a statement that the case proves that anti-abortion centers harm not only people seeking abortions but also people who need basic pregnancy care. “These facilities fail to offer safe or legitimate health services, putting patients at serious risk,” she said. “When a person is seeking compassionate abortion or pregnancy care, the last thing they should have to worry about is a false health diagnosis that delays or stands in the way of life-saving treatment.”

Over 311 statements of fact were established in the Arkansas gender affirming care ban case. Not a single fact was found in the state’s favor, and several major talking points were debunked.

 

The crux of Judge Moody’s ruling lies in the substantial 311 individual statements of fact, many of which decisively dismantle arguments made against gender affirming care. These facts apply to issues from the rarity of detransition to the vital medical benefits that gender affirming care offers transgender youth. The statements also rule on the credibility of the state’s experts as well as the plaintiff’s experts. The court found the plaintiff’s experts to be extraordinarily credible, while the state’s experts were deemed to be considerably lacking in credibility and motivated more by religious beliefs than sound policy. Even religious organizations lobbying for anti-transgender laws, such as the Alliance Defending Freedom, are probed within these factual statements.

 

Legislative and media discussions surrounding bans on care for trans youth have primarily concentrated on the health risks and benefits of gender-affirming care. After considering numerous witnesses, hundreds of pages of expert testimonies, and briefs filed by medical organizations, the judge definitively concluded that banning gender-affirming care would inflict severe, irreparable harm on transgender youth. One particularly striking fact, Fact 258, was evidenced by Dr. Dan Karasic, a psychiatrist with over three decades of experience treating gender dysphoria. He alerted the court that “not all adolescents with gender dysphoria will survive to 18 if they are denied gender-affirming medical treatment.”

 

A frequent assertion put forth by advocates for anti-trans care bans is the presumption that transgender youth will eventually regret their transition and detransition. Facts 219-224 determined conclusively that this is not the case. For example, Dr. Karasic pointed out that out of the thousands of patients he has treated, not a single one chose to detransition. While a handful did stop taking their medication, it was primarily due to a lack of family support or their insurance discontinuing coverage, not a change in their self-identified gender.

Judge Moody later dissected the notion that levels of “desistance and regret” warrant prohibitions like Arkansas’s ban on gender-affirming care. He stated:

To the contrary, the evidence proved that there is broad consensus in the field that once adolescents reach the early stages of puberty and experience gender dysphoria, it is very unlikely they will subsequently identify as cisgender or desist.

A federal court blocked Florida’s new drag show law, ruling the state’s effort to bar children from attending “adult live performances,” is overly vague and likely unconstitutional. The decision Friday by U.S. District Judge Gregory Presnell comes only a day after another federal court overturned another Gov. Ron DeSantis-backed law prohibiting gender-affirming care treatment in Florida from being covered by Medicaid. “This concern rings hollow, however, when accompanied by the knowledge that Florida state law presently and independently… permits any minor to attend an R-rated film at a movie theater if accompanied by a parent or guardian,” Presnell ruled.  “This statute is specifically designed to suppress the speech of drag queen performers,” Presnell wrote in his 24-page decision. “In the words of the bill’s sponsor in the House, State Representative Randy Fine: (the legislation) will protect our children by ending the gateway propaganda to this evil – ‘Drag Queen Story Time.’”

Authoritarian advocates, whatever their form, need some “other” to be dehumanized and oppressed. When everybody more or less has the same race and culture in a country, they then cast about for some other way of differentiating for the purposes of fomenting hate. Sometimes it’s by religion, sometimes by ethnicity, but if those are relatively homogeneous, they’ll go for LGBTQ status or political identity.

For example, in America in the 1950s, they did both of those latter, along with racist bigotry: People perceived to be not-straight and those who were accused of being socialist or communist. All three were targeted for systematic oppression.

The First Amendment of the United States Constitution ensures that all citizens, popular or not, majority or minority, conventional or unconventional, have access to public spaces for public expression.”

In his 80-page ruling, Judge James M. Moody Jr. of Federal District Court in Little Rock said the law both discriminated against transgender people and violated constitutional rights for doctors. He also said that the state of Arkansas had failed to substantially prove a number of its claims, including that the care was experimental or carelessly prescribed to teenagers.
The law is extremely broad, which actually creates a host of other complications. A group of lawyers previously told The Dallas Morning News that the measure could restrict performances by artists such as Madonna and Miley Cyrus, which often feature sexual dancing.
The text could even affect bachelorette parties, if they involved sex toys or other paraphernalia. The new changes could even impact cheerleading and criminalize sexual conduct between consenting 17-year-olds (17 is the age of consent in Texas).
Movie screenings and art history classes could similarly come under fire. And of course, the law will affect its original target: drag performers, Pride parades, and transgender people just trying to live their lives.
Lawsuits against similar bans are planned or already underway in other states. In Florida, the Orlando outpost of Hamburger Mary’s sued the DeSantis administration last month.

The GOP friction stems from a push by Rep Andrew Clyde (R-Ga.) who publicly revived the discussion by trying to prevent funding in an energy and water development bill from being used to rename Army Corps civil works projects that are named after the Confederacy or an individual who served in the Confederate military.

“One of the things that is irritating a few of us: a certain member from Georgia is wanting to re-bring up the Confederate base names,” Rep. Don Bacon (R-Neb.) told POLITICO.

Bacon said he told the Georgia Republican that he would “would fight him” on trying to prevent funding from going toward renaming. (Clyde’s amendment doesn’t mention military bases.)

Bacon led that effort in the House to create the process for renaming the military assets.

He noted on Friday that he recounted to Clyde about how African-Americans have thanked him for his work on renaming the Confederate assets. In a separate statement, Bacon added that the issue was settled in 2020 and that he didn’t think it was “wise to re-litigate” it.

“Confederate generals fought for a cause that we know was wrong and violated their oaths to Constitution. Most of the 10 that bases were named for were also terrible generals. … Finally, some were affiliated with racist actions after the war. Most of these bases were named around WW1 and done to placate the Jim Crow elected leaders at the time,” he added in the statement.

I don’t know the “official thinking” of American historians on point, but I believe much of what we’re seeing today with respect to the Republican Party is 160 years of simmering resentment by the South regarding its loss in the 1860s Civil War now coming to the surface.

Trump “tapped” into it. “Build the wall” was metaphor for “keep the coloreds out.” His embrace of rabid racists, including neo-Nazis, is a “message received” by the Republican base.

They miss the old plantation days, the good old days. When the coloreds and the women knew their place and there was no “deviance” like drag queens and trans people.

June 21 (Reuters) – A U.S. judge on Wednesday struck down a Florida rule and a statute that banned state Medicaid payments for transgender healthcare, marking the second defeat in two weeks for anti-transgender legislation in the state.

U.S. District Judge Robert Hinkle declared the state’s practices invalid, saying they violated the constitutional right to equal protection under the 14th amendment in addition to violating the federal Medicaid statue and the Affordable Care Act’s prohibition of sex discrimination.

The injunction was expected after Hinkle on June 6 partially blocked Florida from enforcing its recent ban on people under 18 receiving gender-affirming care such as puberty blockers and hormone therapy.

U.S. district court judges elsewhere have blocked state laws banning gender-affirming care in Alabama, Arkansas, Indiana and Oklahoma.

Republican lawmakers introduced more than 500 bills restricting LGBTQ rights this past legislative year, passing more than 70, according to Human Rights Campaign. Twenty states have passed laws banning gender-affirming care for minors.

Sponsors of the laws say they want to protect children who are being misled by parents and doctors and might regret their gender transition.

Hinkle in his 54-page ruling said “many people with this view tend to disapprove all things transgender and so oppose medical care that supports a person’s transgender existence.”

“The elephant in the room should be noted at the outset. Gender identity is real. The record makes this clear,” the judge wrote after a two-week trial.

The plaintiffs were two transgender adults, August Dekker and Brit Rothstein, and two transgender minors who filed under pseudonyms.

The defendants were the Florida Agency for Health Care Administration (AHCA) and its secretary, Jason Weida, who did not respond to an after-hours request for comment.

The AHCA had approved Medicaid payments for the plaintiffs, but in 2022 the executive office of Governor Ron DeSantis ordered the AHCA to conduct a new analysis and reversed course. The AHCA “retained only consultants known in advance for their staunch opposition to gender-affirming care,” the judge found.

“The new … process was, from the outset, a biased effort to justify a predetermined outcome, not a fair analysis of the evidence,” the judge said.

DeSantis is running for the Republican nomination for president and has promoted his record of aggressively fighting progressive policies, including LGBTQ rights.

What’s weird is when members of the majority feel the need to hold their own fake hearing. Politico reported:

Matt Gaetz (R-Fla.), joined by a handful of others from the conference’s right flank, hosted an event last week with former Trump acting assistant attorney general Jeffrey Clark, people charged in relation to Jan. 6, defendants’ family members and allies. The event featured a veritable kitchen sink of conspiracy theories as well as rehashed false claims, including that the 2020 election was “stolen” and that the Jan. 6 committee “doctored” video.

Just so we’re clear, this was not an actual congressional hearing. The far-right Floridian, however, wanted it to be perceived as one. Gaetz pretended to be a chairman, recognizing members and witnesses, alerting participants to when their time had expired, and explaining that the “testimony” could be used in official proceedings. (That last part was true but irrelevant: Anything can be used in official proceedings, including the blog post you’re reading now.)

A Washington Post investigation found that more than a year would pass before prosecutors and FBI agents jointly embarked on a formal probe of actions directed from the White House to try to steal the election. Even then, the FBI stopped short of identifying the former president as a focus of that investigation. A wariness about appearing partisan, institutional caution, and clashes over how much evidence was sufficient to investigate the actions of Trump and those around him all contributed to the slow pace.

The law is extremely broad, which actually creates a host of other complications. A group of lawyers previously told The Dallas Morning News that the measure could restrict performances by artists such as Madonna and Miley Cyrus, which often feature sexual dancing.
The text could even affect bachelorette parties, if they involved sex toys or other paraphernalia. The new changes could even impact cheerleading and criminalize sexual conduct between consenting 17-year-olds (17 is the age of consent in Texas).
Movie screenings and art history classes could similarly come under fire. And of course, the law will affect its original target: drag performers, Pride parades, and transgender people just trying to live their lives.
San Francisco is definitely facing problems, but you could surely find a similar scene in Miami.

Also in that time, I have seen men defecate on the streets of Dallas and drugs being bought, sold and used on the streets of Dallas. I have seen tent encampments of hundreds of homeless. I have seen those encampments bulldozed. There are beggars on every median at every major intersection citywide.

The price of living is out of whack. Rents are way too high. The people the GQP pander to are the same ones who cause the problem. A perfect example of why it’s like this; developers who are based in one city (or country) own blocks of land in other cities and countries. One block = one apt complex, which is of course “luxurious” and overpriced. This means people who actually live in the city don’t have the money or leverage to make their home town better. It’s very complicated. This is a broken down version of of a broken system.
