In a shocking announcement, Attorney General Kris Kobach of Kansas released an official opinion on Monday that will threaten transgender people’s legal documents in the state. If Kobach’s opinion is enforced, transgender individuals who had moved ahead and legally corrected their birth certificates and driver’s licenses now may have their corrections reversed. The wrong gender marker may be placed on all legal documents provided by the state.
Kansas Senate Bill 180, passed in April, defines sex as “biologically determined at birth.” Kobach interpreted this to mean that state agencies must now revert the gender markers on driver’s licenses and birth certificates for transgender people in the state, even if they were changed legally in the past. This is an unprecedented move; transgender people who have changed their legal documents have often seen those changes as safe from legal interference once the process has been completed.
Kansas is not the only state that could begin taking such steps. North Dakota, Tennessee, and Montana have also passed similar bills this year. There is concern that these states may follow Kansas’ lead in enforcement, leaving transgender people uncertain about how to proceed and protect their legal gender changes.

Yeah, we actually got this in KS news outlets over the weekend. I don’t know how things are in the other states; I can say that KS is short-staffed everywhere because our batcrap crazy legislature won’t fund anything. So, there is time, here, before this happens, because of course, backfitting isn’t going to supersede current work, and there aren’t enough people to have some assigned just to retrofitting. Back when the bill passed (it becomes law on Saturday, July 1st,) the advice for all was to get your documents set up immediately, and all the news outlets included that info then, too. I hope everyone did.
Now, a state AG opinion doesn’t mean law, and Lambda Legal is on this hard here, so it will, I hope, at least be held up in court, at the least for people who already have their papers in order. For those who can’t get it done before Saturday, it’s anybody’s guess, though. An AG opinion does form policy, because someone like Kobach especially isn’t above making things difficult for those who don’t believe following his policies is the Christian thing to do (and it’s not.)
Again, I apologize, but things like this are what I mean when I call our legislators batcrap crazy. They spent a lot of time making this law, not so much time on water safety, road maintenance, and such things as are the actual job of a state legislature. Many families with trans kids have already left-they moved as soon as schools let out. And that’s our loss.
