Judge blocks Indiana abortion ban on religious freedom grounds

A second Indiana judge on Friday blocked the state from enforcing its law banning most abortions after Jewish, Muslim and other non-Christian women challenged it in a lawsuit.

Marion County Superior Court Judge Heather Welch issued a preliminary injunction against the Republican-backed law, which prohibits abortions with limited exceptions for rape, incest, lethal fetal abnormalities or a serious health risk to the mother. The plaintiffs have argued that the measure infringes on religious freedom protected by another state law.

The law had already been on hold, as another judge in September blocked Indiana from enforcing it while Planned Parenthood and other healthcare providers challenge it in court.

Indiana became the first state to pass a new law banning abortion after the U.S. Supreme Court in June overturned its landmark 1973 Roe v. Wade ruling that had legalized the procedure nationwide. Other Republican-led states quickly began enforcing older bans.

 

Welch issued her injunction after a group called Hoosier Jews for Choice and five individual women challenged the abortion law under Indiana’s Religious Freedom Restoration Act in a case brought by the American Civil Liberties Union. The ACLU said the plaintiffs represented religions including Judaism and Islam as well as “independent spiritual belief systems.”

“The Court finds that S.E.A. 1 substantially burdens the religious exercise of the Plaintiffs,” Welch wrote, using the formal name of the law, in granting the plaintiffs’ motion for a preliminary injunction while the challenge to its legality proceeds.

“Although some religions believe that human life begins at conception, this is not an opinion shared by all religions or all religious people,” the ACLU said in a statement.

    Re: ACLU’s statement — This is the point I was making in one of my own posts … not every religion sees abortion through the same lens. But as most of us know, the whole matter comes down to the Christians trying to force their religious beliefs on everyone else.

    1. Hello Nan. Yes, and more Yes. Dogs that love gravy it is hard for Christians of that bent to understand, but even their own holy books is pro abortion. Ther holy book says that life doesn’t begin until breath, so where or why did they get the idea of life beginning at conception? Because it is about control over females, over women. If they don’t have a life in them until it comes out there can be no reason to make rules condemning them for that swollen belly or for controlling every action they take while their belly is swelling. Sorry Nan. I know you agree with me and I am shouting at the choir but I just get so worked up about these issues. It seems so clear to me, but even when you point out all the clear misconceptions there is a denial of reality. Hugs

      OT. So yesterday when the guys were ripping out old moldy decayed shelves in the shed as they emptied it and while doing so one of the shelves destroyed the water heater. Ron and James went out to a home improvement store and got a better one as ours was bought in 2006. They don’t last forever. James and Ron worked late to get the piping run and the water on. Ron quit before James who drove himself to make sure there was running cold water. Today Ron and James continued working on changing the pipelines and adding / removing values as needed. So about two hours ago the guys said all glue was dry and it was safe for me to start cold water laundry. Then they found a small leak, then when I turned the old washer on Ron came rushing in to shut it off. Seems the value in the old washer was shot and it was running cold water back through the hot line causing a couple heavy water leaks. So water shut off, pipes cut, new connections made and another two hour wait. It is nearly 3 PM here and I am just so happy the WordPress carp is not a malware on my system. Hugs
