Before he became a leading voice for conservative causes on Capitol Hill, U.S. SenatorΒ James LankfordΒ spent more than a decade as the director of youth programming at the Falls Creek Baptist Conference Center, a sprawling campground about 80 miles south of Oklahoma City that attracts more than 50,000 campers in grades six through 12 each year.

The Republican lawmaker’s tenure at the camp is a prominent feature of his political profile, noted in the first paragraph of hisΒ official Senate biography. That experience is also coming under renewed scrutiny as the Southern Baptist Convention, which is affiliated with the group that owns the camp,Β faces a reckoningΒ over its handling of sexual abuse cases.

In 2009, while Lankford worked at the camp, the family of a 13-year-old girl sued a 15-year-old boy who was alleged to have had sex with her at the camp. Lankford, who was not in Congress at the time, is not alleged to have had any direct knowledge of the alleged assault, has not been accused of any wrongdoing and was not a defendant in the lawsuit, which was settled for an undisclosed amount before it was scheduled to go to trial.

But in a 2010 deposition in the case, given a week after he was elected to his first term in the U.S. House, Lankford testified that he believed a 13-year-old could consent to sex.

β€œYes, I think they can,” Lankford told Kenyatta Bethea, a lawyer for the girl’s family, according a 155-page transcript of the deposition obtained by The Associated Press.

The age of consent in Oklahoma is 16, and although there is an exception in the law for minors between the ages of 14 and 17 who have sexual contact, there is no provision under which a 13-year-old could consent to sex. When Bethea pressed if his answer was still the same β€œif I ask you that question in terms of your position as a father,” Lankford maintained his stance.

β€œYes, they can,” he said.

Under additional questioning about whether he would allow his two daughters to consent to sex at the age of 13, Lankford gave a more expansive answer.

β€œNo, I would not encourage that at all,” he said. β€œCould she make that choice? I hope she would not, but I would not encourage that in any way with my own daughter.”

It’s unclear whether Lankford, who has no formal legal training, was aware of the legal age of consent at the time of his deposition. It’s also uncertain whether any criminal charges were filed against the 15-year-old boy. Telephone messages left with Murray County District Attorney Craig Ladd were not returned.

The testimony is surfacing before Tuesday’s primary for the GOP Senate nomination that would allow Lankford to seek another term. After early concerns that he could beΒ vulnerable to a challenge from the right, he enters the election in a strong position. The primary winner will head into the fall general election as the overwhelming favorite in this deeply Republican state.

Aly Beley, a spokeswoman for Lankford’s reelection campaign, declined to comment for this story.

The revelation of Lankford’s testimony comes at a difficult moment for the Southern Baptist Convention.

A scathing investigative report, conducted by an independent firm, found that top SBC leaders stonewalled and denigrated survivors of clergy sex abuse while seeking to protect their own reputations. In response, theΒ SBC voted overwhelminglyΒ earlier this month to create a way to track pastors and other church workers credibly accused of sex abuse and launch a task force to oversee further reforms in the nation’s largest Protestant denomination.

This is not the first case of alleged sexual assault at Falls Creek, a 400-acre campground nestled in the Arbuckle Mountains. The camp is owned by the Baptist General Convention of Oklahoma, which is now called Oklahoma Baptists and is part of the SBC.

Benjamin Lawrence PettyΒ pleaded guilty in 2018 to raping a 13-year-old Texas girlΒ at the camp. Petty, who was a cook at the camp, tied a rope around the girl’s wrists, raped her and threatened to hurt her if she told anyone, according to investigators. Petty was ultimately sentenced to probation in the case, and aΒ civil case filed by the girl’s familyΒ against the Baptist General Convention of Oklahoma was settled. The terms of the settlement were not disclosed.

Lankford no longer worked at the camp when the attack occurred.

Court records show that Rev. Lori Walke, an attorney and senior minister at Mayflower Congregational Church in Oklahoma City, served as a guardian ad litem for the Texas girl during the civil case. Walke declined to talk about details of the case, but said she attended Falls Creek as a young girl and has serious concerns about how the camp operates.

β€œEven as a kid, you recognize some things that feel off,” Walke said. β€œThis real obsession with the purity culture is overwhelming. The rules around clothing, particularly for girls, were just obsessed over.”

β€œAnd then, the real lack of oversight, generally speaking, in all other matters,” she added. β€œIt was absolutely due to the fact that there’s just not enough adults around.”

Oklahoma Baptists did not respond to questions about how many cases involving sexual misconduct at Falls Creek have been settled. In a statement, Executive Director-Treasurer Todd Fisher said the recent vote to approve recommendations from the SBC’s task force will bring about needed national reforms.

β€œI am thankful Oklahoma Baptists already made significant steps toward preventing abuse in Oklahoma, implementing a number of best practices in all areas of our ministries, including at our encampments,” Fisher said.

Oklahoma Baptists spokesman Brian Hobbs said some of those best practices for Falls Creek include mandatory background checks for anyone 18 and older, increased security, professionally developed safety training for all camp staff and church leaders bringing groups to the camp and protocols for reporting abuse or suspected abuse.

During his deposition, Lankford said he had no problem sending his daughters to the camp, including in instances when he was not present, though he acknowledged that supervision wasn’t perfect.

β€œI know that our adults are watching out for our kids, but the process of that, obviously I can’t guess for every adult how they’re going to handle it,” Lankford said.

From Clarence Thomas’s concurring opinion:

The Court’s abortion cases are unique, see ante, at 31–32, 66, 71–72, and no party has asked us to decide β€œwhether our entire Fourteenth Amendment jurisprudence must be preserved or revised,” McDonald, 561 U. S., at 813 (opinion of THOMAS, J.).

Thus, I agree that β€œ[n]othing in [the Court’s] opinion should be understood to cast doubt on precedents that do not concern abortion.” Ante, at 66.

For that reason, in future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell.

Curiously, no mention of “Loving v. Virginia.” How convenient for him and Ginni.

Citing anti-gay discrimination, 2022 Kentucky Teacher of the Year leaving classroom

2022 Teacher of the Year cautions against Kentucky education returning to 'normal' post pandemic

Kentucky Teacher of the Year Tells Congress How Bad LGBTQ Discrimination is in Kentucky Schools | Northern Kentucky News | Cincinnati | Cincinnati CityBeat

Kentucky’s 2022 Teacher of the Year, who is gay, says he is leaving the K-12 classroom β€œto make the most difference, and the discrimination and lack of support prevent me from making that difference.”

After 17 years being a public school teacher, Willie Carver Jr. said he decided to leave the classroom and take a position at the University of Kentucky in student support services.

Carver told the Herald-Leader – and UK officials confirmed – that he will be an academic advisor at the Gatton College for Business and Economics.

β€œI am very excited about this opportunity to continue helping young people in their quest for education, Carver said in a Facebook post. β€œThis was not an easy decision; I have cried quite a few times trying to make it over the past few months. But, ultimately, I have always wanted to be in the place where I can most make a difference in the lives of the next generation. I believe that UK is where I can do this.”

β€œI also increasingly find that, as a queer person in K-12 education, I have been unable to do that work without facing discrimination, heartache, and being a part of systems that cause harm, though I am immensely proud of my brilliant, hardworking, and fierce colleagues who have and continue to change that system in defense of students.”

In May, Carver told a Congressional subcommittee that he faced discrimination as a gay teacher and that hatred was the norm in schools. The panel was examining the wave of race and LGBTQ censorship engulfing America’s K-12 classrooms.

Carver, who had been teaching high school in Montgomery County, told the Herald-Leader that β€œvocal anti-LGBTQ extremists at school board meetings (and on social media) have been personally attacking me and my former students.”

β€œThe national rhetoric is turned up, and LGBTQ teachers bear the weight of a lot of hatred that catalyzes the vitriol. It’s tiring,” he said.

Carver said he had been unable to find support from his school administration. β€œMr. Carver is a wonderful English and French teacher. We wish him well in his new endeavor,” Montgomery County Superintendent Matthew Thompson said.Β

Carter said he had been proud to be a teacher and had worked tirelessly for students and their families.

He said he found the resources they needed. He said his goal had always been to strengthen his community and teach young people to believe in themselves.

β€œI also know that I symbolize potential for some students. I symbolize potential for students who come from poverty, for Appalachian students, and for LGBTQ students,” said Carver. β€œOf late, I feel beaten down. I’ve withstood it, but it’s hard to find peace or happiness when you’re under attack. This is all the more problematic when a person is a symbol. I can’t risk breaking.”

Some schools are doing incredible work for their students and teachers who are racial or ethnic minorities, or are LGBTQ, he said. Some are not, he said.

β€œSome are doing harm, are rendering people invisible, are illegalizing discussions about queerness or blackness, are afraid to be allies for fear of political retribution,” Carver said.

β€œA question that anyone in a system has to ask is whether they are capable of changing that system or whether they are perpetuating it. I believe that I am able best to work with a system that helps students by moving forward.”

Carver mentioned Tyler Clay Morgan, a former music teacher at Kentucky’s West Irvine Intermediate School who resigned after he wrote a message to students on his classroom board that later became controversial.

Morgan in April confirmed to the Herald-Leader that he wrote a message on his classroom board that said, β€œYou Are Free to Be Yourself With Me. You Matter.” The message included a rainbow flag and rainbow colors.

β€œThis is a message I always tried to teach every student too,” said Carver. β€œI know Tyler and I aren’t alone in this. Thank you to each and every person who has made me, their own colleagues, and their students feel that they mattered.”

This is the red state plan in order to stamp out the “queering” of America.

Make the lives of LGBTs so unpleasant and dangerous that they’re forced back into the closet or leave the state.

A secondary goal is to make public school teaching even more aversive than it is now so that the system collapses.

And now they have the courts to help them accomplish their goal.

“A federal appeals court on Wednesday upheld Arkansas’ law requiring state contractors to pledge not to boycott Israel, finding the restriction is not an unconstitutional violation of free speech.

The full 8th Circuit U.S. Court of Appeals reversed a 2-1 decision last year by a three-judge panel of the court that found the requirement to be unconstitutional.

The Arkansas Times had sued to block the law, which requires contractors with the state to reduce their fees by 20% if they don’t sign the pledge.” *

Long Island library board votes to β€˜remove all Pride displays’ and LGBTQ books from children’s section

A library on Long Island has voted to remove β€œall Pride displays” as well as Pride-related books from its children’s sections.

The Smithtown Library Board of Trustees voted 4-2 Tuesday to ban any and all displays related to LGBTQ Pride from kids’ areas at Smithtown Library buildings, a move that was met with fierce backlash and call for action by advocates.

The New York Library Association slammed Smithtown’s move, calling it β€œa direct violation of NYLA’s commitment to intellectual freedom and the freedom to read that libraries are entrusted to uphold.”

The organization reaffirmed its commitment to stand alongside the LGBTQ community, β€œespecially our LGBTQ+ youth, who utilize libraries across the state as a refuge to foster their love of learning and of their authentic selves.”

Library officials didn’t immediately respond to a request for comment on the ban, but library directorΒ Robert Lusak toldΒ NewsdayΒ that at least 29 books are affected by the ban. They include a history of the AIDS Memorial Quilt and picture books like β€œPink is for Boys” and β€œPride Puppy.”

Governor Kathy Hochul tweeted Wednesday night that β€œour public spaces should be accepting our young people β€” not rejecting them,” reminding all LGBTQ New Yorkers that the state supports and welcomes them.

The LGBT Network, a nonprofit that fights for the rights of LGBTQ people and their families in Queens and Long Island, has planned a press conference for late Thursday morning to announce its plans to oppose anti-LGBTQ measures in libraries and schools.

The library’s β€œbigoted move” to remove the books and Pride displays β€œenraged members of the LGBT community in Suffolk County, where over 100,000 LGBT residents reside,” the group said in a statement ahead of the press event.

SCOTUS Rules To Protect Cops From Miranda Violations

CNNΒ reports:

The Supreme Court limited the ability to enforce Miranda rights in a ruling Thursday that said that suspects who are not warned about their right to remain silent cannot sue a police officer for damages under federal civil rights law even if the evidence was ultimately used against them in their criminal trial.

The court’s ruling will cut back on an individual’s protections against self-incrimination by barring the potential to obtain damages.

It also means that the failure to administer the warning will not expose a law enforcement officer to potential damages in a civil lawsuit. It will not impact, however, the exclusion of such evidence at a criminal trial.

Five of nine justices were appointed by presidents who lost the popular vote (GWB and Girth, Wind, and Liar [h/t Colbert]). LGBTQ students would get new protections under Biden plan

https://apnews.com/article/campus-sexual-assault-rules-overhaul-title-IX-anniversary-518710ef2b76663c240dc0272903fe93

The rights of LGBTQ students would become enshrined in federal law and victims of campus sexual assault would gain new protections underΒ new rules proposed by the Biden administrationΒ on Thursday.

The proposal, announced on the 50th anniversary of theΒ Title IX women’s rights law, is intended to replace a set of controversial rules issued during the Trump administration byΒ Education Secretary Betsy DeVos.

President Joe Biden’s education secretary, Miguel Cardona, said that even though there have been significant strides toward gender equality, discrimination and sexual violence persist.

β€œEven as we celebrate all the progress we’ve achieved, standing up for equal access and inclusion is as important as ever before,” he said.

The proposal is almost certain to be challenged by conservatives, and it is expected to lead to new legal battles overΒ the rights of transgender studentsΒ in schools, especially in sports. It now faces a public feedback period before the administration can finalize any changes, meaning the earliest that the policy is likely to take effect is next year.

The step meets a demand from victims rights advocates who wanted Biden to release new rules no later than the anniversary of Title IX, which outlaws discrimination based on sex in schools and colleges.Β Advocates say DeVos’ rulesΒ have gone too far in protecting students accused of sexual misconduct, at the expense of victims.

As a presidential candidate, Biden had promised a quick end to DeVos’ rules, saying they would β€œshame and silence survivors.”

In announcing its proposal, Biden’s Education Department said DeVos’ rules β€œweakened protections for survivors of sexual assault and diminished the promise of an education free from discrimination.”

For the first time, the rules would formally protect LGBTQ students under Title IX. Nothing in the 1972 law explicitly addresses the topic, but the new proposal would clarify that the law applies to discrimination based on sexual orientation and gender identity.

It would make clear that β€œpreventing someone from participating in school programs and activities consistent with their gender identity would cause harm in violation of Title IX,” according to the department. More specific rules dealing with the rights of transgender students in school sports will be released later, the department said.

Biden marked the anniversary of Title IX by acknowledging the impact the law has had in advancing equity but acknowledging there was more to do.

β€œAs we look to the next 50 years, I am committed to protecting this progress and working to achieve full equality, inclusion, and dignity for women and girls, LGBTQI+ Americans, all students, and all Americans,” he said in a statement.

Many of the proposed changes would restore Obama-era rules that DeVos’ policy replaced.

The definition of sexual harassment would be expanded to cover a wider range of misconduct. Schools would be required to address any allegation that creates a β€œhostile environment” for students, even if the misconduct arises off campus. Most college employees, including professors and coaches, would be required to notify campus officials if they learn of potential sex discrimination.

In a victory for victims rights advocates, the proposal would eliminate a rule requiring colleges to hold live hearings to investigate sexual misconduct cases β€” one of the most divisive aspects of DeVos’ policy. Live hearings would be allowed under the new policy, but colleges could also appoint campus officials to question students separately.

Biden’s action drew praise from victims rights groups, LGBTQ advocates and Democratic lawmakers.

β€œThese proposed regulations demonstrate a strong commitment to protecting educational opportunities for all students including LGBTQ students,” said Janson Wu executive director of Gay and Lesbian Advocates and Defenders. β€œEspecially in light of ongoing state legislative attacks, we are grateful for the administration’s strong support of LGBTQ youth.”

Republicans in Congress were quick to denounce the proposal. Rep. Virginia Foxx of North Carolina, the top Republican on the House Education and Labor Committee, said the rules will β€œdemolish due process rights and the safety of young women and girls across the country, with promised regulations still to come to undermine women’s access to athletic opportunities.”

If the proposal is finalized, it would mark the second rewrite of federal Title IX rules in two years. DeVos’ rules were themselves intended to reverse Obama-era guidance. The Obama policy was embraced by victims advocates but led to hundreds of lawsuits from accused students who said their colleges failed to give them a fair process to defend themselves.

The whiplash has left many schools scrambling to adopt ever-changing rules. Some have pressed for a political middle ground that will protect students without prompting new rules every time the White House changes power.

β€œIt doesn’t serve anybody’s interest to have this ping-pong effect of changing rules every five years,” said S. Daniel Carter, a campus security consultant and president of Safety Advisors for Educational Campuses. β€œThat’s just not a good way to get things done. It’s very difficult for everyone involved.”

DeVos’ rules dramatically reshaped the way colleges handle allegations of sexual assault and harassment, with an emphasis on ensuring the constitutional due process rights of the accused.

Under her rules, accused students were given wider rights to review and respond to evidence against them, and students had the right to cross-examine one another through a representative at live hearings.

The live hearing requirement was applauded as a victory for accused students, but it drew intense backlash from other advocates who said it forced victims to relive their trauma.

DeVos also reduced colleges’ obligations in responding to complaints. Her policy narrowed the definition of harassment and scaled back the types of cases colleges are required to address. As a result, some campuses have seen steep decreases in the number of Title IX complaints coming in from students.

Under her rules, for example, colleges are not required to investigate most complaints that arise off campus, and they do not have to act on any complaint unless the alleged misconduct is β€œsevere, pervasive and objectively offensive.”

The overhaul was partly meant to lighten the burden on colleges as they mediate complex cases, but some say it ultimately added more work.

Leaders of some colleges have said the DeVos rules are too prescriptive and force them to turn campus discipline systems into miniature courtrooms. Many schools have continued to address all sexual misconduct complaints even if they do not meet the narrowed harassment definition, but they have had to set up separate discipline processes to handle those cases.

Advocates on both sides say that can be confusing for students.

β€œIt shouldn’t be that way. It should be, if anything, more uniform β€” that’s the whole reason the Title IX regulations were put into place,” said Kimberly Lau, a New York lawyer who represents students in Title IX cases

Biden’s proposal is a major step in keeping his promise to reverse DeVos’ rules. He started the process last year when he ordered the Education Department to review the rules, but the agency has been bogged down by a slow-moving rule-making process.

NY Gov Blasts β€œShocking” SCOTUS Ruling On Guns

The right to have a gun without being in a militia or military was a new right created by gun lover Anton Scalia and even he said there were some limits.Β  Β  Β That is the meaning of activist judges, he loved guns and played with guns and wanted guns freely taken everywhere.Β  Β But nowΒ  the SCOTUS are removing any restrictions based on a mythical romanticized verson of what the US was and founded to be.Β  The fact is for all of US history guns were very tightly controlled, they were not just carried by everyone everywhere.Β  Β It was not that way.Β  Β Those myths of the wild west of gun touting people shooting everywhere and people like the rifle man solving all the problem is not real and is a stupid fantasy.Β  The SCOTUS is an ideology driven group that is going to cause the entire country to crash and burn.Β  Β All to push a religious ideology.Β  Β Scary.Β  Β Hugs

Does everyone understand what a concealed weapon means? That you have no forewarning. That someone can hide a weapon on them and go into our subways, go into our grocery stores, like stores up in Buffalo, New York, where I’m from. Go into a school in Parkland or Uvalde, This could place millions of New Yorkers in harm’s way.

As governor of the state of New York, my number one priority is to keep New Yorkers safe, but today the Supreme Court is sending us backwards in our efforts to protect families and prevent gun violence.

And it’s particularly painful that this came down at this moment, when we are still dealing with families in pain from mass shootings that have occurred, the loss of life, their beloved children and grandchildren.

I’m prepared to call the Legislature back into session to deal with this. We’ve been in contact with leadership β€” we’re just looking at dates β€” but I will say, we are not powerless in this situation.

We’re not going to cede our rights that easily, despite the best efforts of the politicized Supreme Court of the United States of America.

This decision isn’t just reckless, it’s reprehensible. It’s not what New Yorkers want, and we should have the right of determination of what we want to do in terms of our gun laws in our state.
