Nebraska passes anti-trans sports ban misleadingly called “Fairness for Girls initiative”

This horrific event is the result of the democrats withdrawing on supporting / informing the public on the issue and letting the right-wing misinformation and disinformation sway the public.  First the number of trans athletes is small, and second all the medical / scientific evidence shows what they are trying to prevent is not happening.  Plus the safety threats are not happening nor are the sexualizing by showing genitalia in locker rooms happening.  It is a total lie and bigotry supported by religion, a lack of understanding science, and the misconception that because determening sex has always been done based on whether something dangles or not that it is the correct and only way to determine sex or gender.  If democrats had not shrank from the issue and kept supporting the rights all of this could have been prevented.   We have observed that when the issue of same sex attraction rights was being debated and then with same sex marriage once democrats pushed support for it by making sure the truth of the issues was pushed it overwhelmed the misinformation and lies of the bigots.   As soon as the democrats pulled back their support public support for both issues diminished.  But this election proved that the right wing / republican push against LGBTQ+ people, especially trans people were easy for democratic canidates to defuse and by supporting the trans people these democrats still won their elections.  They showed that the scary trans adverts and slogans used by the right really don’t resonate with most people.  I beg our democratic party elected and future candidates to fully support the LGBTQ+ people of all ages with the facts, science, and medical data.  It is time to put the idea that bigotry, hate, and especially religiously driven bigotry works to the trash heap with other failed ideas that were proven wrong.  No matter how hard some people try to cling to tradition it is never a good reason to deny people rights.  Also notice it is always focused on trans girls but never mentioned are trans boys.  That is because it is easier to get less informed people emotionally invested in the idea that girls are at risk than boys being at risk.  It is misogeny.  It is a threat to men that other men would be willing to give up the privilege of being male, but to those same kinds of guys that feel women are lesser than men a woman wanting to be  have the same status as a male they can understand.   They can’t grant it as it undermines their idea of male superiority but it doesn’t hurt their male egos like trans women do.  And of course this is just a gate way into banning transitioning.   First it was bathroom bans but they failed to get much support, but the protect daughters in sports and bathrooms hit the right never to push these bills ever further with the goal of stopping the right to transition entirely which has now happened in many red states due to the republican majority on the SCOTUS being both highly religous and highly republican goal driven.  Hugs.

Nebraska voters have approved of ballot Measure 442, the so-called “Fairness for Girls initiative, The Daily Nebraskan reported, with 67% of voters supporting the initiative as of midnight local time.

The measure will write into the state constitution a 2025 law, sponsored by state Sen. Kathleen Kauth (R), that already requires public K-12 and college athletes to play on teams matching their sex at birth. The measure defines one’s sex at birth as having a reproductive system that “does or at some point will produce, transport, and utilize” either eggs ( for a woman or girl) or sperm (for a man or boy).

The measure applies to all athletic teams or sports sponsored by public schools, postsecondary educational institutions, private schools, or educational institutions that compete against public schools. Opponents of the measure accused its creators of using deliberately misleading language to gain voter support for the measure, though the state Supreme Court disagreed.

Interestingly, the state Supreme Court recently heard arguments challenging the measure’s legality. Opponents say that the ballot measure’s sponsors failed to “adequately inform the public of what they are trying to accomplish” when collecting signatures for the effort.

The measure’s ballot language says, “The object of this petition is to amend the Nebraska Constitution to establish constitutional protections for sex-separate athletics to ensure equal access to athletic opportunities for females.”

The plaintiff’s lawsuit said the language failed to properly describe the “legal effect of the filing of the petition and the object sought to be secured by submitting the measure to the voters.” The language “omits major provisions contained in the Initiative’s text and does not accurately reflect the text of the Initiative,” which could lead voters to support it without understanding its consequences, the plaintiff claimed.

More specifically, the plaintiff’s lawsuit noted that the ballot language fails to inform voters that the amendment applies to all public and private schools from childhood to adulthood, and:

  • imposes requirements based on biological sex;
  • prohibits male students from participating in sports and teams designated for female students;
  • applies to recreational intramural sports, as well as interscholastic and intercollegiate sports; and
  • does not actually guarantee equal access to athletic opportunities.

In the state Supreme Court’s recent ruling, the justices wrote that the state ballot language law “does not require an initiative’s object statement to set forth every consequence that would result from the initiative measure should it be adopted by voters.”
