Federal Judge Strikes Down LGBTQ Protections Against Workplace Discrimination

Judge Matthew Kacsmaryk’s ruling marks one of the most alarming judicial rollbacks of LGBTQ rights in recent memory.

On Thursday, Judge Matthew Kacsmaryk — a far-right federal judge in the Northern District of Texas with a record of aligning with the GOP’s most extreme legal positions — issued a ruling declaring that Title VII no longer protects LGBTQ+ people from workplace discrimination. The decision directly contradicts the Supreme Court’s landmark 2020 ruling inBostock v. Clayton County, which held that discrimination based on sexual orientation or gender identity is, by definition, sex discrimination. Kacsmaryk’s ruling marks one of the most alarming judicial rollbacks of LGBTQ+ rights in recent memory — and sets up a direct legal challenge to one of the foundational civil rights protections for queer and trans people in the United States.

The case was brought against the EEOC by the state of Texas alongside the Heritage Foundation, a central force behind Project 2025 — an aggressive right-wing policy blueprint that explicitly calls for rolling back LGBTQ+ protections in federal law. In siding with the plaintiffs, Judge Kacsmaryk pointed to the Texas Department of Agriculture’s current employee policy, which requires “employees to comply with this dress code in a manner consistent with their biological gender,” specifying that “men may wear pants” and “women may wear dresses, skirts, or pants.” The ruling also upheld the department’s policy banning transgender employees from using restrooms that align with their gender identity.

The judge reached a verdict that Title VII only protects “firing someone simply for being homosexual or transgender,” but that it does not protect transgender or gay people from “harassment”:

“In sum, Title VII does not bar workplace employment policies that protect the inherent differences between men and women,” Kacsmaryk writes in his ruling.

Judge Kacsmaryk further argued that disparate treatment of transgender employees does not constitute unequal treatment, reasoning that “a male employee must use male facilities like other males” — a statement that erases transgender identity altogether. He extended that logic to dress codes and pronouns, claiming that requiring employees to adhere to clothing standards and pronoun use based on their assigned sex at birth is not discriminatory because it applies “equally” to everyone. The argument mirrors the discredited legal reasoning once used to uphold bans on same-sex marriage — that such laws didn’t discriminate against gay people because they, like straight people, were allowed to marry someone of the opposite sex. It’s a circular logic designed to mask exclusion as neutrality. It also flies in the face of the fact that Texas allows people assigned female at birth to wear gender “pants, skirts, and dresses” but denies that same right to people assigned male at birth.

Kacsmaryk, a former lawyer for an anti-LGBTQ hate group, was exposed in 2023 for failing to disclose millions in stock holdings.

Kacsmaryk was previously exposed for failing to disclose viciously anti-LGBTQ interviews and acting to hide his authorship of an anti-abortion article ahead of his Senate confirmation hearing.

Republican and Christian groups regularly filed their lawsuits in his district because they know they’ll get a friendly ear.

Transgender people’s lives at risk of being made ‘unliveable’, says Nicola Sturgeon

Former Scottish first minister expresses concern about interim advice from EHRC

Nicola Sturgeon

The lives of transgender people in the UK are at risk of being made “unliveable”, Nicola Sturgeon has said in her first public comments about the supreme court ruling on the legal definition of a woman, which was prompted by legislation she oversaw in the Scottish parliament.

The UK supreme court ruled that the terms “woman” and “sex” in the Equality Act referred only to a biological woman and to biological sex. This was the conclusion of a long-running court action by the gender critical campaign group For Women Scotland, who objected to a law passed at Holyrood aimed at improving women’s representation on public boards being extended to transgender women.

Sturgeon said the supreme court’s ruling – “by very definition … the law of the land” – could not be questioned but expressed profound concerns about interim advice published by the Equality and Human Rights Commission amounting to a blanket ban on trans people using toilets and other services of the gender they identify as.

“The question for me, and I think for a lot of people, is how that is now translated into practice; can that be done in a way that, of course, protects women, but also allows trans people to live their lives with dignity and in a safe and accepted way.

“I would be very concerned if that interim guidance became the final guidance and I hope that is not the case because I think that potentially makes the lives of trans people almost unliveable.

“It certainly doesn’t make a single woman any safer to do that because the threat to women comes from predatory and abusive men.”

The former first minister and SNP leader added that it was not inevitable that the judgment would make the lives of transgender people “impossibly difficult”, but there was a danger that certain interpretations could put transgender rights at risk.

“If that is the case, then yes, it would be my view that the law as it stands needs to be looked at,” she told reporters at the Scottish parliament on Tuesday.

The Scottish media and prominent gender critical campaigners have been calling on Sturgeon to respond since the ruling, which prompted jubilation among gender critical activists and sent shock waves through the trans community.

Sturgeon has been a staunch advocate of transgender rights, and the final years of her premiership were dominated by the increasingly toxic and polarised debate around the passing of her flagship gender recognition reforms in late 2022.

The bill, which was passed with cross-party support at Holyrood, made it easier and less intrusive for individuals to legally change their gender, extending the new system of self-identification to 16- and 17-year-olds for the first time. But it was immediately blocked by the Rishi Sunak’s UK government as cutting across the UK-wide Equality Act.

After this unprecedented veto, Sturgeon accused some opponents of the bill of using women’s rights as a “cloak of acceptability to cover up what is transphobia”, telling the NewsAgents podcast that some critics of the legislation were also “deeply misogynist, often homophobic, possibly some of them racist as well”.

On Tuesday Sturgeon rejected the suggestion made by many of her critics that she owed them an apology after the ruling.

“I fundamentally, and respectfully, disagree,” she said. “I recognise the different views on this, I’ve always recognised the different views on this, but I think its important that respect runs in both directions.”

But co-director of For Women Scotland, Susan Smith, said Sturgeon’s claim that life would be made “unliveable” was “frankly wrong and quite disturbing”. Smith told BBC Scotland News that single-sex spaces were needed to provide women with “privacy, dignity, safety at time when they’re vulnerable”.

AAP Statement on HHS Report Treatment for Pediatric Gender Dysphoria

https://www.aap.org/en/news-room/news-releases/aap/2025/aap-statement-on-hhs-report-treatment-for-pediatric-gender-dysphoria/

By: Susan J. Kressly, MD, FAAP, president, American Academy of Pediatrics

“The American Academy of Pediatrics (AAP) is deeply alarmed by the report released by the U.S. Department of Health and Human Services (HHS) today on medical care for transgender and gender-diverse individuals and the process that informed its development. For such an analysis to carry credibility, it must consider the totality of available data and the full spectrum of clinical outcomes rather than relying on select perspectives and a narrow set of data.

This report misrepresents the current medical consensus and fails to reflect the realities of pediatric care.

As we have seen with immunizations, bypassing medical expertise and scientific evidence has real consequences for the health of America’s children. AAP was not consulted in the development of this report, yet our policy and intentions behind our recommendations were cited throughout in inaccurate and misleading ways. The report prioritizes opinions over dispassionate reviews of evidence.

Patients, their families, and their physicians—not politicians or government officials —should be the ones to make decisions together about what care is best for them based on evidence-based, age-appropriate care.

We urge government officials and policymakers to approach these conversations with care, humility, and a commitment to considering the full breadth of peer-reviewed research. The AAP remains focused on supporting pediatricians in delivering the best possible care to every child, informed by science and the lived experiences of patients and families. We will continue to support the well-being of all children and access to high-quality care that meets their needs.”

Poland finally repealed the country’s last “LGBT-free” zone

Ten years after the far-right Law and Justice Party was elected to power in Poland, and two years after their defeat in national elections, a last vestige of the party’s state-sanctioned anti-LGBTQ+ policies has finally been eliminated.

On Thursday, a council in the southeastern Polish town of Łańcut officially abolished the country’s last remaining ‘LGBT-free’ resolution.

Requests to remove books from library shelves are on the rise in the UK, as the influence of pressure groups behind book bans in the US crosses the Atlantic, according to those working in the sector.

Most of the UK challenges appear to come from individuals or small groups, unlike in the US, where 72% of demands to censor books last year were brought forward by organised groups, according to the American Library Association earlier this week.

However, evidence suggests that the work of US action groups is reaching UK libraries too. Alison Hicks, an associate professor in library and information studies at UCL, interviewed 10 UK-based school librarians who had experienced book challenges. One “spoke of finding propaganda from one of these groups left on her desk”, while another “was directly targeted by one of these groups”. Respondents “also spoke of being trolled by US pressure groups on social media, for example when responding to free book giveaways”.

The types of books targeted may also differ. “Almost all the UK attacks reported in my study centred on LGBTQ+ materials, while US attacks appear to target material related to race, ethnicity and social justice as well as LGBTQ+ issues,” said Hicks.

This supports the findings of an Index on Censorship survey last year, in which 28 of 53 librarians polled reported that they had been asked to remove books from library shelves, many of which were LGBTQ+ titles. In more than half of those cases, books were taken off shelves.

Tennessee county sued for banning books without even reading them

Trump DOJ Ordered ICE to Invade Homes Without Search Warrant

The Justice Department quietly authorized immigration agents to seize power in arresting people under the Alien Enemies Act—no warrant required.

https://newrepublic.com/post/194440/donald-trump-restores-foreign-students-visas-legal-losses

The Justice Department quietly invoked the Alien Enemies act last month to give Immigration and Customs Enforcement agents the power to conduct warrantless searches of people’s homes as long as they suspect them to be an “alien enemy.” USA Today obtained the memo that contained this order on Friday.

In the memo, the Justice Department defined an “alien enemy” as anyone who is 14 years of age or older, not a U.S. citizen or lawful permanent resident, a citizen of Venezuela, and “a member of the hostile enemy Tren de Aragua,” per the Alien Enemy Validation Guide, a document that has already been slammed by immigration experts.

The broad definition has already resulted in the apprehension and deportation of more than 200 men to El Salvador who just happened to have tattoos, like gay makeup artist Andry José Hernández Romero.

This type of order will likely lead to more indiscriminate arrests and wanton racial profiling. The memo, which is from March 14, is another massive departure from the U.S. immigration norms.

White House Confirms Trump Is Exploring Ways To ‘Deport’ U.S. Citizens

The administration could try removing American citizens if it identifies a pathway it can claim to be legal.

White House press secretary Karoline Leavitt said Tuesday that President Donald Trump is exploring legal pathways to “deport” U.S. citizens to El Salvador, where the administration has already arranged to house deported immigrants in a prison known for its human rights abuses. (Watch the video, above.)

Trump told reporters aboard Air Force One on Sunday that he “love[s]” the idea of removing U.S. citizens, adding that it would be an “honor” to send them to El Salvadoran President Nayib Bukele — an eager partner in Trump’s schemes.

“I look forward to watching the sick terrorist thugs get 20 year jail sentences for what they are doing to Elon Musk and Tesla,” Trump wrote. “Perhaps they could serve them in the prisons of El Salvador, which have become so recently famous for such lovely conditions!”

Shocking report reveals HIV deaths will explode due to Trump’s foreign aid cuts

https://www.lgbtqnation.com/2025/04/shocking-report-reveals-hiv-deaths-will-explode-due-to-trumps-foreign-aid-cuts/

Nearly half a million children could die from AIDS-related causes by 2030 without restoration of PEPFAR programs cut by the Trump administration, a new study published in the Lancet reveals.

The new health policy analysis estimates that one million children could become infected with HIV and nearly half a million could die from AIDS by 2030. Additionally, 2.8 million children could experience orphanhood in sub-Saharan Africa (because their parents died from preventable HIV-related illnesses) if the PEPFAR funding isn’t restored.

A study released by UNAIDS in March showed an uptick in new HIV infections has already started as local HIV prevention programs funded by PEPFAR have been thrown into chaos.

Men who have sex with men, girls, and young women between the ages of 15 and 24 not pregnant or breastfeeding, and sex workers and people who inject drugs “can not” be offered PrEP during the pause or “until further notice,” Trump administration officials wrote.
