Christian teacher wins $95,000 settlement after misgendering student for “religious” reasons

https://www.lgbtqnation.com/2022/09/christian-teacher-wins-95000-settlement-misgendering-student-religious-reasons/

Can anyone show me where in the bible Jesus said don’t be respectful or don’t be kind to others and never use the name / pronouns they prefer.   Where in the bible did their god write only use male pronouns for beings with swing penises, something I highly doubt God the father he himself has?  Really the supreme being in your religion who is super magical, has a penis?   If not then you are using a preferred pronoun!   Did god ever write be an asshole over changing someone’s name, or did he himself command it several times?   This is just hate packaged as religion to get permission from the government to be an asshole and a jerk.   How much more superior that teacher must feel after treating a kid so crudely.    I hope everyone learns that they do not want to ever be like her.   Somehow for the good of the students we must get teachers like her out of teaching.   When did the rules of a job just not apply to those who claim religion?   Are we a theocracy or a democracy?   Again what is the big issue religiously with calling someone by a name they prefer, we use nick names for people all the time.   I think this is part of the stereotype gender role that must be enforced by the fanatically religious.    Woman’s clothes, men’s clothes, woman’s job, men’s job, woman’s names, men’s names, and so on.   I don’t think clothing, jobs, names and so on really need to have a gender assignment.   Is Kim a male or female name?  Depends where you are.  What about Sandy?    Hugs

A teacher in Kansas was awarded $95,000 Wednesday to settle a lawsuit after she misgendered a student but claimed that she should be allowed to because of her religious beliefs.

The former math teacher at Fort Riley Middle School, Pamela Ricard, claimed it was a violation of her religious beliefs to use the preferred pronouns of a trans boy student and insisted on addressing him as “miss.”

She was reprimanded and suspended for three days for violating the bullying, diversity, and inclusion policies. She sued the school district.

The lawsuit alleged the Geary County School District denied Ricard’s request for a religious exemption to its policy that school staff use students’ preferred pronouns. The district also directed teachers to use a student’s legal name when communicating with parents, concealing the student’s pronoun preference, according to the suit.

“No school district should ever force teachers to willfully deceive parents or engage in any speech that violates their deeply held religious beliefs,” Tyson Langhofer, Ricard’s lawyer, told the AP.

The anti-LGBTQ hate group Alliance Defending Freedom (ADF) and the Kriegshauser Ney Law Group filed the case on Ricard’s behalf.

Addressing the student as “miss” was Ricard’s attempted workaround to the school’s insistence she address him by his preferred name.

According to the lawsuit, Ricard believed using “Miss (legal/enrolled last name)” respected the student while also upholding Ricard’s religious convictions, despite the fact that that was deliberately misgendering the boy and also singling him out for differing treatment from his classmates.

Ricard said she believes God assigns gender at birth, according to the lawsuit. The school’s policy requiring her to use language that doesn’t conform to a student’s biological sex “actively violates Ms. Ricard’s religious beliefs.”

The settlement came about after a federal judge ruled the lawsuit could proceed, citing its likely success based on her free exercise of religion claim. The judge also granted Ricard’s motion to halt the district’s parental communication policy. Soon after, the district school board formally revoked the guidance.

The judge also ruled, incongruously, that Picard could avoid using students’ preferred pronouns but should address them by their preferred names.

Picard retired in May. Along with the $95,000 award, she won a statement from the school district that she was in good standing without any disciplinary actions against her.

GOP Wisconsin governor candidate donated $250K to anti-LGBTQ & anti-abortion groups

When they tell you who they are believe them the first time!   We need to understand how anti-democracy these republicans are.  We need to understand how badly they crave the power to rule over everyone to force their Christian doctrine on to the public at large.   We must defeat them at all costs if we want to have civil rights, a secular society, and a democracy of the people for the people.   Hugs

Tim Michels, the Republican candidate running for Wisconsin governor, donated $250,000 in 2020 to groups opposing abortion and all forms of contraception, and to anti-LGBTQ churches. The donations, made along with Michels’s wife Barbara through their foundation, The Timothy and Barbara Michels Family Foundation, represent 15 percent of the candidate’s total donations in 2020, according to a report by The Milwaukee Journal Sentinel.

Along with donations totaling $175,000 to radical anti-abortion organizations in Wisconsin and New York, the Michels gave $10,000 to Miami’s Christ Fellowship, whose parishioners include former Republican presidential candidate Marco Rubio. Christ Fellowship’s pastor, Omar Giritli, delivered an anti-transgender sermon in May, in which he attacked Caitlyn Jenner and preached that God believes transgender people are an “abomination” and a “rebellion to their creator.” A 2015 Huffington Post report detailed the church’s consistent anti-LGBTQ message.

Spring Creek Church in Pewaukee, Wisconsin also received a $50,000 donation from the couple. The church’s pastor, Chip Bernhard, has reportedly suggested that allowing transgender children to use bathrooms that correspond to their gender identity is “awful.”

“While the media is desperate to find lines of attack, their generosity helps support causes they believe in and funds cancer research and other Christian causes,” Michels’s campaign spokesperson Anna Kelly told The Milwaukee Journal Sentinel.

Michels, meanwhile, has tried to downplay social issues on the campaign trail. “The people who feel the Democratic party has left them for social issues, you are now going to have a governor that’s going to stand up for the hard-working, tax-paying, law-abiding citizens of Wisconsin,” he said early last month after winning the Republican primary.

Michels is running to unseat incumbent Governor Tony Evers (D).

“Tim Michels will stop at nothing to push his radical agenda in order to limit the rights of LGBTQ Wisconsinites and those seeking an abortion,” Democratic Party spokesperson Hannah Menchhoff said. “If elected, Tim Michels will implement radical policies that are out of touch with the majority of Wisconsinites.”

Colombia’s leftwing government unveils tax-the-rich plan to tackle poverty

https://www.theguardian.com/world/2022/aug/26/colombia-tax-the-rich-plan-poverty-gustavo-petro

See how easy it could be.    Tax the wealthy as they have all the money and use that tax to let the government help the public who need it.     Do this here.   Tax the wealthy and channel the taxes raised into anti-poverty efforts, free public universities and other social welfare programs.   Everything written in this article about Colombia is the same in the US.   All of it is happening here as it is there.    If they can do we can do it.    We need to do it.    Hugs

President Gustavo Petro’s proposed legislation could raise $11.5bn a year with measures including wealth tax and levy on oil exports

Colombia’s new leftist government has proposed an ambitious plan to tax the rich in an effort to combat poverty in one of the most unequal countries in the Americas.

If implemented, the Piketty-esque legislation proposed by President Gustavo Petro could raise more than $11.5bn annually to fund anti-poverty efforts, free public university and other social welfare programs.

Petro, a former urban guerrilla who became the country’s first leftist leader, rose to power on a raft of promises centered around social progress at a time when the South American country is still plagued by pandemic-fueled economic turmoil.

If passed, the plan would raise taxes on the country’s highest earners – approximately 2% of Colombia’s population – cut tax benefits for the richest and fight tax evasion.

The tax hikes would progressively increase as income increases. It would add an annual wealth tax on savings and property above $630,000, and would add a 10% tax on some of Colombia’s biggest exports – oil, coal and gold – after prices rise above a certain threshold.

“This should not be viewed as a punishment or a sacrifice,” said Petro. “It is simply a solidarity payment that someone fortunate makes to a society that has enabled them to generate wealth.”

The wealth tax was among Petro’s chief promises during his campaign and would mark a significant step toward achieving his bold policy agenda, which has inspired hope in some and skepticism in others.

It is also part of a larger debate playing out around the world at a time of deepening global inequalities.

“This is not just Colombia,” said economist Álvaro Pardo. “This is a large conversation in any country – the ideas of equity and progress, the idea that those who have the most have to pay more. These are universal concepts we’re drawing upon.”

Petro’s proposal has prompted alarm in the country’s private sector and political elite who argue the tax will dampen investment, push job creators out of the country and – according to the arch-conservative former president Álvaro Uribe – potentially deepen poverty.

“We support all these efforts for the country to overcome poverty,” Uribe said following a meeting with Petro this summer. “But not at the cost of withering away the private sector.”

But at the height of the country’s decades-long armed conflict, Uribe imposed a similar temporary tax in order to fund his war with the Revolutionary Armed Forces of Colombia (Farc) guerrilla group.

Last year, amid stewing resentment for Petro’s predecessor, Iván Duque, another tax reform proposal ignited months of anti-government protests, which became symbolic of deeper social unrest and endemic inequalities.

“It was sort of a perfect storm from political opposition to the government, post-pandemic economic hardship and the government’s response,” said Sergio Guzmán, director of Colombia Risk Analysis. “Under this government, things are different.”

This bill, he said, “is more progressive in nature”, doing away with key exemptions that he and economists say have allowed richer individuals to pay lower taxes than the average Colombian.

It’s also more permanent than other wealth taxes. The measure will now have to go through congress, where it is likely to pass.

The proposal was a welcome move for many Colombians who have felt like they have been on the outside looking in.

Marlon Mendoza, an Afro-Colombian entrepreneur on the Caribbean coast, was one of 1.6 million Colombians who, during the pandemic, were knocked out of the middle class and back into poverty.

“The poor got poorer, and the rich got richer,” he said.

He went from having an office and a home in the city of Cartagena to returning to the unpaved streets of his town of birth on the outskirts of the city, struggling paycheck to paycheck.

Some observers warn that the tax plan will only address the tip of the iceberg.

Pardo said: “The challenge is gigantic because it means breaking a structure that has been in place for decades, a structure that favors rich sectors and big companies. It’s going to be very difficult.”

But it’s that painful growth that needs to happen, says Mendoza.

“This is a new idea. Human beings, not just Colombians, we’ve gotten used to the status quo. Down the line, if that thing is hurting us, it’s hard to branch away from what we’re used to.” he said. “But if we don’t do that, there will never be change.”

51% Of FL 10th Graders Fail English Proficiency Exam

The Florida Phoenix reports:

In Florida’s public schools, the 10th grade statewide English Language Arts assessment has been a crucial exam — kids have to pass it to get a standard high school diploma. But the 2022 spring exam results show that fewer than half of Florida’s 10th graders passed the ELA exam, troubling because students will be getting closer to entering the workforce or going to college.

Overall, 49 percent of 10th graders got a passing score of at least 3 on the spring ELA exam. In total, 202,900 10th graders took the exam, according to data from the Florida Department of Education. The school district with the lowest percent of passing ELA scores in 2022 was Jefferson County, located in North Florida, with only 15 percent of 10th graders passing the exam.

Read the full article. A score of 4 or 5 is required to show “proficiency” in reading and writing. Of note, the above-cited Jefferson County, which is majority white, is locally famous for having no traffic signals.

DeVos was a plant of the Religious Right acting through their puppet, Trump. Her goal was to destroy the public education system in America.

Much like the goal of another Trump hack — Louis DeJoy — is (“is,” because much to America’s peril he’s still in place) to destroy the U.S. Postal Service.

There hasn’t been a Democrat as Governor of Florida in over 20 years… this is entirely on Republicans and demonstrates, as Republican leadership tends to do over and over again, that Republicans cannot lead effectively. Republican led states tend to fail in every category whether it’s education, health, employment, average pay, or any other measurement you choose.

The anti-trans middle school vice principal who threw beer on a woman has been reinstated

https://www.lgbtqnation.com/2022/08/anti-trans-middle-school-vice-principal-threw-beer-woman-reinstated/

The arbitrator said the man shouldn’t be disciplined for protecting his wife.   But that is not what he was doing.   They were in a public place and his wife was loudly causing a scene about a transwoman.   A fellow patron started recording the wife, the man got up to confront the woman recording them.    Now that woman was with in her rights, he is going to her to confront her.   The woman says “Please take your hate elsewhere,” the patron who is recording them said. Michael Smurro then threw his beer at the woman.  He threw his beer on a woman because he was angry she asked him to take his bigotry elsewhere, he was angry she dared tell him what to do.  So he threw his beer on her.  Is that the way we want someone who is in the job of “Vice Principal of Safety”  to act?    Really this is what we should teach kids, that when you are angry it is OK to pour your drink on someone?   But I am glad the school district is standing up for the LGBTQ+ and want him to resign.   Hugs

Dozens attended a New Jersey school board meeting to denounce the reinstatement of Neptune Middle School’s former Vice Principal Michael Smurro.

A viral video recorded by patrons shows Michael Smurro and his wife, Lisa, at the outside seating area of a local restaurant as Lisa Smurro ranted loudly about a transgender woman who used the bathroom. When the Smurros realize that someone at a different table was recording them, they get up to confront that person, while Lisa Smurro continued to rant about the trans woman.

“Please take your hate elsewhere,” the patron who is recording them said. Michael Smurro then threw his beer at the woman.

The video of the confrontation quickly garnered national media attention.

The recording raised questions about what happened that day, particularly, whether or not Mr. Smurro engaged in transphobic behavior himself. Smurro quoted the transphobic slur of the unidentified woman his wife used when explaining the incident to District Superintendent Dr. Tami Crader, according to the investigation.

The Neptune Township Board of Education requested his termination and the commissioner’s office agreed. However, Barbara C. Deinhardt, the arbitrator, disagreed with the school board and approved his return to work starting on August 18.

“The district took legal action to terminate [Smurro] through tenure charges, but the arbitrator assigned to the case instead ruled in favor of the penalty of six months unpaid suspension. Mr. Smurro’s tenure remains in place and he has been reinstated as a vice principal of safety located in the central office,” said President Chanta L. Jackson to the audience.

Lisa Smurro was the only individual using transphobic language, therefore, he can’t be guilty by association, according to the investigation’s 35-page decision.

“The theory that because he defended his wife who arguably expressed intolerance for transgender persons, he thereby discriminated in the provision of benefits or services to students is far-fetched,” reads Deinhardt’s conclusion.

Superintendent Crader agreed with the public consensus in the investigation. However, Jackson warned the board couldn’t respond to public questions involving the employment or discipline of employees before public comment.

Michael Hoffman, the father of children in the school district, believes in forgiveness. He believes in second chances, yet, he believes as a public official the vice principal should resign regardless of the arbitrator’s award.

“A person in this light should not work around children. By bringing this person back we are showing children it’s okay to lead with anger and violence,” said Hoffman. “Neptune, I’m asking you to stand up and be a school where trans kids and all kids can grow up and feel safe.”

Hoffman’s words echoed others who spoke in the public portion of the meeting – including his wife Kym Hoffman.

Kym Hoffman is running for the Board of Education in the general election. The incident partially encouraged Hoffman’s run for public office. Her hope is to continue Neptune’s LGBTQ training, inclusivity and equity in the school, while making an effort to hold people in power accountable.

“There is nothing we can legally do now, but push for [Smurro’s] resignation,” Hoffman said.

The reinstatement comes at a vulnerable time for civil rights in classrooms as hundreds of anti-LGBTQ education bills trickle throughout the country.

“As of April 2022, there have been more than 300 anti-LGBTQ+ bills proposed in the U.S. Forty-two percent of LGBTQ+ youth seriously considered attempting suicide last year, and for transgender and nonbinary youth that number increases to 52%,” said Hoffman.

Ethan Dayback, a Neptune resident and transgender activist, reminded the district that he isn’t going anywhere and called for Smurro’s resignation.

“We live in this community. We get up and go to work everyday. We have friends, we have family. We’re just like everybody else, and we deserve to have protections just like everybody else; and that includes not having unsafe people around children,” Dayback told the board.

Dayback went on to explain the harm LGBTQ children face throughout their lives, but that he is living proof that life goes on.

“I want the kids to see that I am here. I am a functioning adult. It wasn’t always easy, but I kept going. If you are a queer child and you are watching this, and you feel like all of these people aren’t protecting you… [it’s] because they’re not.”

A handful of students founded Neptune Township High School’s Gay Straight Alliance (GSA) while Bastian Poranski was a senior at the Jersey Shore high school in 2008. Poranski was elated to join. Only four people did. Fear of being retaliated against for being out, for being proud, kept people from joining. Still, Poranski found strength in four.

“So when I heard about other schools discriminating against LGBTQ+ youth, I was like: ‘Well, no. It’s not my school. I’m glad that’s not my school,” Poranski told the board at Monday night’s meeting. “But that’s not the case today.”

However, the school board president said she is doing her best.

Jackson said she appreciates the attendance of the concerned public in an email to LGBTQ Nation.

“Please know that this board amended our district’s slogan to reflect ‘A Community for ALL Learners’,” Jackson wrote. “We aim to embody this in all that we do.”

With the inclusion of ongoing training in concepts related to the LGBTQ community over the last two years, the school district is working in preparation for New Jersey’s Diversity and Inclusion Law to diversify hiring practices too.

“[We] have updated all school and classroom libraries to include offerings that portray political, economic, and social contributions of persons with disabilities as well as from lesbian, gay, bisexual, and transgender people,” Jackson said.

Smurro was unable to be reached for comment.

Biden Faces Criticism For Calling Out A Hard Truth About Trump Supporters

Cochise County sheriff: 7-year-old student had 2 guns, ammunition in backpack

https://www.azcentral.com/story/news/local/arizona-breaking/2022/08/30/cochise-county-sheriff-7-year-old-boy-had-2-guns-ammo-in-backpack/7942704001/

What the hell is going on!   This is lawful gun ownership when a 7 year old can get ahold of and go to school with 2 handguns and ammo?   Why did the kid feel he should take them to school.   What kind of storage did the parents have for the guns?   Hugs

A 7-year-old boy at a Cochise County school was discovered with two guns and ammunition in his backpack on Monday, according to the Cochise County Sheriff’s Office.

Deputies arrived and met with school officials and the second-grade student, who they learned was discovered with a gun and ammunition inside of his backpack. After searching his backpack, they found a second handgun.

The Cochise County Sheriff’s Office did not identify the student nor specify what school the incident occurred at.

The parents of the student were contacted, and a “juvenile referral” was completed for charges of misconduct with a weapon and a minor in possession of a firearm.

Similar incidents have taken place in Arizona this year. On Thursday, a gun was confiscated from a fourth-grade student attending Legacy Traditional School in Queen Creek.

And in March, a 15-year-old teenager was arrested after he brought a gun to Verrado High School and had it confiscated by officials.

High school Christian club that rejects LGBTQ students reinstated by court order

https://www.lgbtqnation.com/2022/08/high-school-christian-club-rejects-lgbtq-students-reinstated-court-order/

Another way Christianity is getting permission to discriminate.   I remember about five years ago a LGBTQ+ group was forced by the court to allow anti-gay Christians to not only join the group but also seek leadership positions.   The LGBTQ+ gay support group was sued by the Christians who demanded that they be allowed not only to join but run for the top position of the club, with the idea of changing it to anti-gay.   The courts ruled that the gay club had to let the Christians join and a short time later the support group disbanded.    But my dogs that love gravy when the situation is reversed no way those gays deserve equal treatment.  Notice the judge called out the teachers who may have made fun of or insulted the students who were religious in the club, but totally ignored the insults and attacks by Christians students and teachers on the LGBTQ+ students.    Welcome to the US Taliban theocracy.   Hugs

In a major victory for religious freedom advocates and a defeat for LGBTQ rights, a three-judge panel in California reinstated a public school club in San Jose that denied membership to LGBTQ students based on a “Sexual Purity” pledge.

On Monday, the Fellowship of Christian Athletes was ordered reinstated for the current school year while litigation continued in a lower court.

Writing for the majority, Trump appointee Judge Kenneth Kiyul Lee of the U.S. 9th Circuit Court of Appeals said the case represented “two competing values that we cherish as a nation: the principle of non-discrimination on the one hand, and the First Amendment’s protection of free exercise of religion and free speech on the other hand.”

Non-discrimination lost.

The case emerged from an all-school controversy in 2019, when a teacher at Pioneer High School in San Jose asked students what they thought about the Christian club’s “Sexual Purity” pledge, which according to court records states: “The Bible teaches that the appropriate place for sexual expression is in the context of a marriage relationship. The biblical description of marriage is one man and one woman in a lifelong commitment.”

Leaders of the group were required to sign.

Students weren’t having it.

Protests erupted outside the club’s meetings, and complaints were filed. Teachers and allies spoke out publicly.

The outcry prompted the San Jose Unified School District to rescind the club’s official status. The club sued, alleging religious discrimination.

In his opinion, Lee said the crux of the issue was how the school district applied its non-discrimination policy to all school clubs, not just the Christian Fellowship group.

“Under the First Amendment, our government must be scrupulously neutral when it comes to religion: It cannot treat religious groups worse than comparable secular ones,” he wrote. “But the School District did just that.”

The judge cited a “Senior Women Club” that excluded male students, and a “Big Sisters/Little Sisters” club that was “obviously intended” to serve female students, not male students.

While the court didn’t “minimize the ostracism that gay and lesbian students may endure,” Lee wrote, “in our pluralistic society in which people from diverse backgrounds must coexist despite having starkly different worldviews, the Free Exercise Clause requires the government to respect religious beliefs and conduct, even if many people may find such beliefs to not be ‘acceptable, logical, consistent, or comprehensible.’”

Lee cited numerous recent precedents upholding religious freedom, from the Supreme Court down.

He also called out “animus” in the school’s treatment of the faith-based group.

According to the court’s findings, one teacher called the club’s beliefs “bulls—”, another described evangelical Christians “as ‘charlatans’ who perpetuate ‘darkness’ and ‘ignorance,’” and another “denigrated his own student as an ‘idiot’ for empathizing with FCA members who faced backlash from teachers and students.”

“This is not, to put it mildly, neutral treatment of religion,” Lee wrote. “More than a whiff, a stench of animus against the students’ religious beliefs pervades the Pioneer High School campus.”

The school district said it was “reviewing the court’s opinion, assessing options, and will determine next steps as soon as possible.”

Trump DEMANDS “New Election Immediately”

“Former President Donald Trump reiterated his demand for a new election in a bizarre post published the wee hours of the morning on his social network site TruthSocial.

“The Presidential Election was BADLY & IRREPARABLY TAINTED by the FBI’s FAKE description of the ‘Laptop from Hell’ to Facebook & the LameStream Media – & for MANY other reasons as well,” Trump posted at 1:46 a.m. on Tuesday.

“Declare the rightful winner, or hold a new Election, NOW! Our Country, which is failing badly, knows the ‘score,’ and will never accept Criminal Election Interference. The FBI just fired its Special Agent In Charge of this outrageous & very illegal assault on the Constitution of the United States of America!” he added.

Trump had previously called for his reinstatement as president on Monday.

“So now it comes out, conclusively, that the FBI BURIED THE HUNTER BIDEN LAPTOP STORY BEFORE THE ELECTION knowing that, if they didn’t, “Trump would have easily won the 2020 Presidential Election.” This is massive FRAUD & ELECTION INTERFERENCE at a level never seen before in our Country. REMEDY: Declare the rightful winner or, and this would be the minimal solution, declare the 2020 Election irreparably compromised and have a new Election, immediately!” he posted on Truth Social.”
