Are the authorities powerless to stop Tommy Robinson’s online output?

New laws may make it easier to pursue far-right activist over alleged role in spreading disinformation

Images of Tommy Robinson using his phone while sunbathing in Cyprus as a Rotherham hotel housing asylum seekers was set alight have prompted outrage among those long concerned about his ability to inspire far-right action, even from a distance.

Yet while he has long seemed able to operate with impunity, events may finally be catching up with the man who first rose to prominence in 2009 as the de facto leader of the now defunct English Defence League (EDL).

Far from being powerless to pursue Robinson, new legislation means the authorities may be able to move more easily against those who share damaging information online that they know to be untrue.

Robinson, whose real name is Stephen Yaxley-Lennon, is already known to be among those who are being looked at by police for their alleged role in disseminating disinformation.

A former director of public prosecutions, Ken Macdonald KC, spelled out on Monday how he believed investigators would want to quickly identify individuals who are involved in “online organisation, online incitement and online conspiracies”.

“I think prosecutors will want to have a strategy to identify people who may have been involved in inciting and encouraging these events, and they will want to arrest them and build cases against them. These are, in one sense, the most important people,” Lord Macdonald told BBC Radio 4’s World at One.

While Robinson has been abroad since 28 July, when he fled the UK on the eve of a high court hearing over contempt of court proceedings, he has maintained a near constant commentary on events in the UK since the fatal stabbings of three young girls in Southport on 29 July, sharing claims that police have described as false.

While he has long been a prolific user of multiple social media platforms – benefiting in particular from the return of his X account after Elon Musk bought Twitter – going after him for his online output is not clear-cut.

Dominic Grieve, a former attorney general for England and Wales, told the Guardian: “It is an offence to incite violence on the grounds of race, belief or sexual orientation, and there is incitement to hatred. But it’s a grey area between the right to criticise and incitement to hatred and is a very difficult area to police.

“Quite simply, that’s why it is possible for people to play around with that area. Either you clamp down on it, in which case legitimate freedom of speech gets eliminated and breeds undesirable problems of its own, or you live with it and challenge those views through debate.”

Recent changes in the law open up other possibilities. Since January, an amendment to the Online Safety Act 2023 allows for the prosecution of those who convey information that they know to be false and “if the person intended the message, or the information in it, to cause non-trivial psychological or physical harm to a likely audience”.

Ashley Fairbrother, a senior prosecutor at the law firm Edmonds Marshall McMahon, said: “This now makes the circulation of damaging and false information online into an offence in its own right.” (snip-More)

Virginia man charged with threatening to kill Vice President Kamala Harris

A Virginia man has been charged with making death threats against Vice President Kamala Harris and appeared in federal court on Monday.

According to court records, Frank Lucio Carillo made several threats against Harris, President Joe Biden, FBI Director Christopher Wray, several Arizona officials, and others on the right-wing social media platform Gettr.

In response to a subpoena, the FBI found 4,359 posts from Carillo “targeting various public officials,” including Harris.

In several posts, Carillo allegedly threatened to cut out Harris’ eyes and described various ways he wanted to kill the vice president, court records say.

“I will cut your eyes out,” Carillo allegedly wrote in one expletive-laden rant where he called Harris a “b*tch” and said he hoped she would “suffer a slow agonizing death.”

A number of similar posts are cited in court records, with graphic and detailed threats against the vice president as well as others, including one Islamophobic post in 2023 when he wrote that people should “go out with your guns and kill all Muslims.”

When FBI agents first arrived at Carillo’s house over the social media posts, Carillo asked if they were there “about the online stuff,” and said, “I posted it.” Carrillo, appearing to talk to himself, also said, “I guess I’m gonna need a lawyer,” according to court documents.

Federal agents retrieved two firearms from his home, including a pistol he bought in 2023 and a rifle purchased this year.

A hearing to determine whether Carillo will remain behind bars while awaiting a resolution in his case has been set for Thursday. (snip)

Note from A: I love this writer. He’s a heck of a great human. I used to read him when he wrote for the Wichita Eagle, and since have sort of kept up with different things he’s done over time. He wrote back a thank you note to me when I wrote in to thank him for some particularly incisive, also brave, coverage. I don’t recall what, but I’ll never forget he wrote back. What’s more, the grievance and resentment at the heart of Trumpist nationalism in America is in some ways quite similar to the mentality of Putinist nationalism in Russia: One obsesses over losing the culture war and being disrespected by the “elites”; the other, over losing the Cold War and being disrespected by the West. Perhaps this explains other similarities in the two mindsets, from the penchant for provocation and in-your-face defiance of norms to the affinity for conspiracy theories. I am as pissed as she is.  I was watching Emma on The Majority Report.  She is totally anti-Biden and has been for a couple of years, but it got much worse over Gaza.  She is adamant that Biden be replaced.  She doesn’t care, she is convinced that who ever it is will win.  And they will bring Israel to heel.   With no facts or figures to back it up.  Sam has backed off that position a lot.  But on today’s show Emma and guests were talking about how horrible Biden was and the George Clooney op ed in the paper, where he claims Biden is not the same person he met years ago.   But even when they reported that the White House said Clooney left hours before Joe Biden showed up.  They laughed it off.  They thought it was funny that the White House would point out that the man had no way to know how Joe Biden performed because he was not there to see it.  No facts get through their convictions.  They are like covid and vaccine deniers about this.  And the damage they are doing, they might as well be getting paid by the tRump campaign.  They never talk about how bad tRump is anymore, they don’t talk about the lies tRump made at the debate, they never talk about where tRump has been the past several weeks while Biden has been doing public events every day.  Biden every day they ignore, tRump nowhere to be seen they ignore, to beat a dead horse of a bad debate.  If Biden loses, they will be one of the major reasons.  Hugs.  Scottie

The New York Times reports:

Former President Donald J. Trump has escalated his vows to prosecute his political opponents, circulating posts on his social media website invoking “televised military tribunals” and calling for the jailing of President Biden, Vice President Kamala Harris, Senators Mitch McConnell and Chuck Schumer and former Vice President Mike Pence, among other high-profile politicians.

One post that he circulated on Sunday singled out Liz Cheney, the former Wyoming congresswoman who is a Republican critic of Mr. Trump’s, and called for her to be prosecuted by a type of military court reserved for enemy combatants and war criminals.

A separate post included photos of 15 former and current elected officials that said, in all-capital letters, “they should be going to jail on Monday not Steve Bannon!” Those officials included Mr. Biden, Ms. Harris, Mr. Pence, Mr. Schumer and Mr. McConnell — the top leaders in the Senate — and Representative Nancy Pelosi, the former House speaker.
