FIRE warns HB 1119 will increase Florida school book banning

These hateful Christian bigots think any mention or media showing that LGBTQ+ people exist is pornography.  It isn’t and makes a mockery of protecting kids from real porn.  But they use these words and equate any mention or sign of LGBTQ+ with porn to make it seem as harmful and dangerous as showing hardcore rape porn to children.  See the quote below.  Their goal is again to wipe any mention of the LGBTQ+ from society and public view.  They learned from Putin who used the same protect the children tactic.  Think of this if this bill passes how do they justify the Bible in libraries and schools?  But these people want a straight cis white male dominated society where they get to force their church doctrines on the public.  However these same people scream parental rights or religous freedoom if you ask them to give others respect and equality.  They want to oppress everyone else but any attempt to get them to give the same respect they demand for their ideas to others who have different beliefs is persecuting them.  Hugs

On the full House floor, sponsor Rep. Doug Bankson called HB 1119 a “commonsense policy that answers a simple question: Should pornography be available to minors in our schools?”

FIRE warns HB 1119 will increase Florida school book banning

‘Our focus right now is on making legislators aware of the bill’s constitutional problems.’

The Foundation for Individual Rights and Expression (FIRE) is urging the Senate to kill a bill passed by the House that First Amendment advocates fear will increase book banning in Florida schools.

“Library book removals can raise serious First Amendment issues,” FIRE’s Public Advocacy Director Aaron Terr wrote in a letter last week to Senate President Ben Albritton. “The bill creates a powerful incentive for individuals to object to any book they dislike or consider inappropriate, knowing it will be immediately pulled from circulation for all readers.”

The House passed HB 1119 via a 84-28 vote following a partisan debate. An identical Senate bill (SB 1692) has not moved in the upper chamber since it was filed last month.

HB 1119 would block schools from considering the literary, artistic, political or scientific value of books if the material is deemed otherwise harmful for minors.

On the full House floor, sponsor Rep. Doug Bankson called HB 1119 a “commonsense policy that answers a simple question: Should pornography be available to minors in our schools?”

“The answer is an emphatic no,” he told lawmakers.

Bankson and other Republicans argued some inappropriate books still exist on the shelves because of a loophole from the application of the Miller Test, which is a Supreme Court decision dealing with adult material.

The Apopka Republican filed similar legislation last year that advanced in the House but died in the Senate.

FIRE argues that HB 1119 goes too far.

“To be clear, not every book is appropriate for every student,” the Philadelphia-based First Amendment advocacy nonprofit wrote in the letter.

“Again, FIRE recognizes that school districts have a responsibility to assess whether library materials are appropriate for students of different ages. But any such assessment must be carefully crafted to ensure that students are not broadly denied the opportunity to read age-appropriate works that speak to their particular interests.”

The bill wouldn’t allow school officials to take into account the full content of the book or if the work has serious literary, artistic, political, or scientific value for minors of any age since it doesn’t consider grade levels, FIRE said.

“These elements of the Miller test are critical to preventing censorship of literature, art, medical textbooks, history texts, and other speech that depicts or alludes to sex simply because someone finds them offensive,” FIRE said.

“In other words, older students’ access cannot be restricted based on what may be unsuitable for younger children. But HB 1119 disregards this commonsense principle. It requires districts to ‘discontinue use of the material’ if they determine it is ‘harmful to minors,’ without regard to age or grade level.”

Florida passed a 2023 law that allows people to challenge book titles they find offensive for young people in schools.

“Under the current statute, Florida school districts have removed hundreds of books from libraries, including titles that are by no stretch of the imagination ‘pornography’ and come nowhere close to the legal definition of obscenity,” FIRE said in the letter.

“The Florida Department of Education’s own report shows that during the last school year, literary classics and widely acclaimed modern works — including ‘One Hundred Years of Solitude,’ ‘A Clockwork Orange,’ ‘The Human Stain,’ ‘The Kite Runner,’ and ‘Life of Pi’ — were removed even from libraries serving students in grades 9-12. If enacted, HB 1119 will only accelerate this trend and further narrow the range of ideas on school library shelves.”

When asked by Florida Politics whether FIRE would sue if the Legislature passes the bill, the organization did not answer.

“Our focus right now is on making legislators aware of the bill’s constitutional problems,” FIRE spokesman Jack Whitten said. “That’s a decision that would require internal discussion and depend on various factors.”

  1. oh it goes much deeper than that, I suspect. Christianity has its nose in the air over an incredible amount of stuff, and they just LOVE banning stuff, be it ministers, books, or even funny looks on the bus…

    1. Plus that’s the same old playbook they’ve used for decades, if not longer. Anything they don’t like is pornography. When asked in court what that means, they’ve said they’ll know it when they see it. If we the people allow this stuff, we’ll give ourselves the world of “Inherit The Wind” and “1984.” This is at the level that we the people can make the calls and write the letters and show up if there’s an office in our towns, and stop this stuff. Until the next time they try it again.

It’s very difficult to get this stuff repealed once it’s in place.

      1. Hi Ali. Well said. Right now the republicans and their media are rushing full steam down the hill to the chasm where the bridge has fallen in. I have no clue how to stop them or to fight back any harder than we are all trying to do here. Call, write, post, encourage, make sure their true motive is well known, and to show their lies and misinformation.

Sadly the religious bigotry has infected the SCOTUS, which denied medical science and studies to push bigotry when they were informed that the the claims of the trans haters were lies, misrepresentations of the studies and misinformation. The authors of the studies wrote the court to say their studies did not say what the bigots claimed. But Alito said it did not matter, shouldn’t the court act to protect the children from being different from how god made them or being different from their peers? He said the court should act with great caution and agree with transitioning bans even social ones because the matter was in dispute and maybe we should give the anti-trans people more time to find something that would help their case. One of the liberal justices pointed out the courts in the past acted to protect minorities and ensure all were treated fairly, which again was rejected by the religious conservatives led by Alito.

As to how to reverse the damage done, hopefully the blue states can keep the dream of equality and progressive reforms going. I had depended on social media to show young people how normal LGBTQ+ people / kids are and to push acceptance and tolerance to the public. But that will be hard under the current drive by right wing billionaires with the goal of pushing hard the most hard right ideologies and preventing anything positive about the LGBTQ+ community or woke to be seen on these platforms. I admit it feels so much like what I heard it was like in Germany in the late 1930s. We the accepting tolerant majority are being dragged and corraled by a vocal hateful vicous gang of thug minority into a regressive controled state where personal liberties are granted or removed by the authorities arbitrarily with no say by the majority. Look at what it took to reform Nazi Germany. I hope it doesn’t take that for us. Hugs

    2. Hi Judy. Yes but they got worse during Reagan with the made up “silent majority.” Then after the rise of attack Christianity and the NIFB hate churches it got much worse. When in the early 2000s schools were makeing great strides with acceptance and tolerance via strong antibullying campaigns those groups couldn’t stand it. Randy Fine who was a Florida congress critter said it made him cry that kids were coming out and being welcomed by the other kids. Fine said in his days in school he and the other kids would attack, beat up, and terrify gay kids into not being gay (he thinks being in fear to be yourself is a cure instead of just hiding). He was one of the authors of the don’t say gay bill that swept the country in red states to try to erase the LGBTQ+ gains and return the country to the regressive fear times of straight cis gangs hunting down LGBTQ+ people to beat up or kill. One of my friends was killed that way. Beaten to death by people encouraged by the Randy Fine’s of this country.

These rabid Christians who do not seem to follow the Jesus of the New Testament want to return the country to what they claim is gods prefered time of the 1950s where everyone pretended to be straight and cis. Everyone pretended that Christianity in your face was OK and pushing the bible on people was good because everyone was or should be their version of christian. They want to return to the days of pretending their religious leaders could do no wrong and wouldn’t ever molest children or steal money. They want a world of white male dominance over women and for non-whites to be lesser people who they could discriminate against and treat like crap. In other words attacking the LGBTQ+ by first going after the trans, wiping out any positive mention or protections for that community and teaching kids to openly hate again is the first step in a country they hope to make of forced religious control over the public. A theocracy controlled by them to represent their version of their god and force everyone to follow their decrees, just like Islamic theocracies in Iran and Afghanistan. Hugs
