January 6 defendants pursue millions in claims through obscure federal process

We are seeing the tRump acting attorney general refuse to put in writing and under oath that the slush fund tRump “settled with himself” over.ย  The courts are demanding the DOJ and the Treasury swear under oath that the idea of such a fund controlled only by tRump is dead and never to be resurrected.ย  The current acting AG refuses because that was the tRump goal all along.ย  As soon as court scrutiny is droped they are planning to do the illegal act anyway.ย  ย These people don’t think laws and rules apply to them and especially never apply to their dear leader tRump.ย  Here is a slightly older article of their attempted work around if the courts stop them entirely.ย  From what I have read the Jan. 6th insurrectionists have already applied to this payout fund and that some may have gotten money from it.ย  Paid to be tRump thugs to do his bidding to stay in power.ย  ย Hugs.

Federal Tort Claims Act, over which DoJ has total discretion, provides workaround to Trumpโ€™s $1.8bn slush fund

January 6 defendants who assaulted police officers are pursuing legal claims for millions in compensation from theย Trump administrationย using an obscure federal process with minimal oversight, but which offers the Trump administration a way to compensate those responsible for violence even after scrapping its โ€œanti-weaponization fundโ€.

The defendants are pursuing their claims using theย Federal Tort Claims Act (FTCA), which allows individuals wronged by the government to file claims for monetary damages. The justice department has complete and unchecked discretion over whether to settle the claims, giving the Trump administration a powerful vehicle to reward those responsible for violence on January 6. The claims would be paid out from the judgment fund, a perpetual appropriation allowed for by Congress and the same pot of money Trumpโ€™s $1.8bn slush fund was going to draw from. All of the defendants seeking compensation received a pardon from Trump.

There was fierce bipartisan pushback to the โ€œanti-weaponization fundโ€ proposed by the administration last month after Trump reached a settlement with the Internal Revenue Service. In particular, members of Congress were concerned that people who harmed law enforcement officers on January 6 might receive compensation. โ€œIf youโ€™ve been convicted of assault on a cop … doesnโ€™t seem to me like people who are victims,โ€ Josh Hawley, a Republican senator from Missouri,ย told NBC News.

While the โ€œanti-weaponization fundโ€ appears to be on ice for now, FTCA claims and lawsuits could provide another avenue for payouts.

โ€œIt risks turning the judgment fund into exactly the sort of slush fund that the โ€˜anti-weaponizationโ€™ was going to be,โ€ said Rupa Bhattacharyya, a former director in the civil divisionโ€™s tort branch at the justice department, who worked on FTCA claims and now is the legal director at the Institute for Constitutional Advocacy and Protection at Georgetown Law.

โ€œIf the treasury department is not going to enforce the restrictions on the use of the judgment fund, which is to settle impending or imminent lawsuits where thereโ€™s some risk of liability, then thereโ€™s no limit on what you can use that judgment fund money for, so long as someone files a bogus claim,โ€ she said.

The justice department agreed to settle FTCA claims filed by Michael Flynn, a former national security adviser, andย Carter Page, Trumpโ€™s foreign policy adviser, forย $1.25mย each earlier this year.

Many of the January 6 defendants are represented by Peter Ticktin, a Florida attorney who is a longtime friend of Trump. He said he had filed about 400 FTCA claims on behalf of January 6 defendants and expects to start frequently filing lawsuits now that the six-month waiting period has expired.

There may also be advantages to pursuing compensation through FTCA claims instead of the weaponization fund, said Mark McCloskey, a Missouri attorney who is representing many January 6 defendants. There were no restrictions on who could apply to the weaponization fund, making the pool of applicants so big that it could lower the per capita recovery, he said.

โ€œThe weaponization fund, for the brief fleeting moment which it allegedly existed, had no policies, procedures, or anything that would indicate what kind of evidence they would have required, what kind of format of a filing they would have required, or anything like that,โ€ he said. โ€œI never thought the weaponization fund, as a practical matter, was very meaningful. Whereas the FTCA gives you a statute with teeth that you can, as long as you can prove your claim, you have a right to recovery.โ€

Among those seeking money are Kenneth Joseph Thomas, an Ohio man who was sentenced to nearly five years in prison after being found guilty forย assaulting several police officers.ย Videoย showed him shoving multiple police officers and throwing himself into a line of officers as he shouted for other rioters to โ€œhold the fucking lineโ€. Also seeking compensation isย John George Todd III, a Missouri man sentenced to five years in prison after being found guilty on several charges, including injuring a Capitol police officer.

Both men are among nine plaintiffs seekingย at least $1m eachย in damages in an FTCA suit filed 29 May in Washington DC. They say they are entitled to damages because they were unfairly and vindictively prosecuted by the government.

Andrew Taake, a Houston man sentenced toย six years in prisonย and who pleaded guilty to assaulting police officers with bear spray and a whip-like weapon, is alsoย seeking at least $2.5m in damages. Taake is entitled to damages because he received inadequate medical treatment and an unfair trial, his lawyers said in their FTCA lawsuit, filed last September in Washington.

Bhattacharyya said she believed the justice department could defend itself against the โ€œmalicious prosecution type claimsโ€ the January 6 defendants were bringing, and she hoped it would do so. When Trump filed his $10bn lawsuit against the IRS, the justice department did not try to defend itself against the suit.

โ€œMost of these plaintiffs were indicted by grand juries, brought before a court. Many of them pled guilty, others were convicted, they were sentenced by judges, and so those sorts of malicious prosecution claims are eminently defensible,โ€ she said.

Those who pleaded guilty or were convicted of assaulting police officers should still be entitled to payouts, McCloskey said. โ€œThe vast majority of people that pled guilty to or were found guilty of such offenses were either coerced into confessions based on threats of life imprisonment and threats against their family or went to trial in courts where the evidence was faked, rigged, perjury was testified to and fair trials were not had,โ€ he said. There is no evidence of wrongdoing in the January 6 prosecutions.

In Taakeโ€™s case, the Trump administration is defending itself against the claims and seeking to have them thrown out. In February, a federal prosecutor in Washington wrote that many of the claims should be thrown outย since the lawsuitย did not name proper defendants and certain requirements were not met before the suit was filed.

The Trump administration faced immediate and bipartisan backlash after it announced it was creating the loosely controlled $1.8bn fund to resolve a $10bn lawsuit filed by Trump related to the leak of his tax returns. Some Republicans objected strongly to the idea that those who assaulted police officers could receive payouts.

โ€œThe concern my constituents and I have is that money possibly going to folks who hit cops,โ€ Nick LaLota, a Republican congressman from New York, told NBC News. โ€œEspecially when there is video evidence, they shouldnโ€™t get a dime from our government.โ€

Adam Schiff, a Democratic senator from California, introduced legislation last month that would bar anyone convicted of an offense related to January 6 from receiving a payout from the federal government. Among other things, the bill would amend the FTCA to prohibit those who were pardoned for actions related to January 6 from being eligible for claims.

โ€œPresident Donald Trump still wants to pay off violent insurrectionists who attacked police officers on January 6th, despite any claims from members of his administration that say otherwise,โ€ Schiff said in a statement. โ€œOur taxpayer dollars should not be used to pay out criminals, and we can pass a law right now to prevent this president or any future administration from paying off their friends and political allies.โ€

New reporting from Axios offers a window into just how far the White House is willing to go to pursue baseless claims made by President Trump for years. The group Democracy Forward obtained new records showing ICE agents went directly to local officials in Texas and North Carolina to obtain voter files. โ€œWe need to be very vigilant and we also need to be outraged,โ€ says Skye Perryman, President and CEO of Democracy Forward. “It’s going to be incumbent upon every single American to make up their mind that we’re not going to have our voices silenced.”

Trans Military Heroes with Historic Retirement Ceremony

At a military retirement ceremony unlike any other in modern American history, five transgender service members stood before their families, colleagues and country to mark the end of careers defined by excellence, leadership and sacrifice. They were not retiring because they failed to meet the standard. They were retiring because the standard was changed to exclude them. 

โ€œTrans servicemembers โ€ฆ are the frontline canaries in the coal mine of our democracy as to who can be seen as not just American, but among the best that America has to offer,โ€ said Shawn Skelly, former assistant secretary of Defense for Readiness and member of HRCโ€™s Board of Directors. 

In addition to providing the official welcome on behalf of the HRC Foundation, Cmdr. Skelly provided a powerful keynote during the morning session and panel focused on military benefits and the future of service for our communities.

HRCโ€™s Equality Center proudly hosted this event on Jan. 8, 2026, to officially retire Col. Bree Fram, Cmdr. Blake Dremann, Lt. Col. Erin Krizek, Chief Petty Officer Jaida McGuire and Sgt. 1st Class Cathrine Schmid. Together, they represent more than a century of service across the Armed Forces. These heroes were also a proxy for the countless more whose stories we have not yet heard but whose service has helped shape a safer, stronger more honorable military and nation.

โ€œThis ceremony is unprecedented,โ€ said retired Maj. Gen. Tammy Smith, who served as master of ceremonies. โ€œNot because their careers fell short in any way, but because they shined so brightly in a military that cast them aside as unworthy.โ€

As former Secretary of the Air Force Frank Kendall observed, what stood out to him was โ€œhow similar these read to those of all other retirees, and to others still serving.โ€ 

The difference, he noted, is that this group was not allowed to continue wearing the uniform. โ€œIt is a huge injustice, and an enormous loss to our nation.โ€

The ceremony was presided over by retired Gen. Stanley McChrystal, whose remarks were as direct as his reputation for leadership. 

โ€œThis isnโ€™t complicated,โ€ McChrystal said. โ€œWeโ€™ve got to leverage every bit of talent that this nation has.โ€ Excluding people who meet every standard weakens readiness and undermines the values the military is meant to defend, he said. (snip-MORE; each retiree gets to share, too)

Donald Trump had an interview with a national news network, and he got fact-checked. Obviously, this network was not Fox News, because it would typically allow him to lie unabated.

It was a wide-ranging interview with NBC Newsโ€™s Kristen Welker that aired Sunday on Meet the Press, and ended abruptly in a hissy fit on his part. Trump claimed that the California gubernatorial primary is โ€œriggedโ€ in favor of Democrats. Instead of letting his lie slide by, Welker pushed back and pointed out that there is no evidence to his claim. Welker was professional and tried to move the interview forward after calling out his lie, but Trump would not let it go.

Trump has a tradition of castigating black female journalists, and he continued it with Welker, saying, โ€œYouโ€™re either crooked or youโ€™re stupid,โ€ before ending the interview in a tantrum. (snip-MORE)

It seems that Donald Trump wants to take something else away from the people and make it all about himself. This time, itโ€™s the NBA finals.

The New York Knicks lead in the finals, 2-0, after defeating the Spurs in the first two games in San Antonio. Now, the series is headed to New York City, where it will resume on Monday night. Not only will there be thousands upon thousands of rabid New York fans waiting for them, but also Donald Trump.

The Knicks haven’t won an NBA Finals series since 1973, and fans are worried that Donald Trump’s presence will jinx their current run, where they have not lost in the last 12 games. The Knicks swept the Cleveland Cavaliers and the Detroit Pistons on their way to meet the Spurs in the finals. The Spurs are supposed to be the better team, but no one has told the Knicks that yet.

Knicks owner James Dolan has invited Trump to attend Monday’s game at Madison Square Garden. Why would he do that? Is he stupid? (snip-MORE)

I considered taking the day off, but I have a hard time not working. I kind of sort of don’t know what to do with myself. So I drew something, but decided not to spend too much time on it.

I was thinking about artificial intelligence and how much I hate it. I really hate these people on social media who use AI to create cartoons. They suck. It annoys me that these people think that they are cartoonists. We all use AI, but I really hate that people are using it for their creative process. Lately, the word โ€œslopโ€ has been used with AI. I don’t know who was the first to use it that way, but it’s most appropriate. When it comes to art, there isn’t a lot of variety in styles with AI, which means that when you use it, it looks generic. I can usually tell when something has been created with AI. (snip-MORE)
