A local Mexican restaurant chain in Pennsylvania is trying to forge ahead a week after a worksite immigration raid left property damage at two of its storefronts and a workforce afraid to show up to their jobs, according to two employees and a witness who spoke with NBC News.

It all started Aug. 7 when immigration authorities showed up at two Emiliano’s Mexican Restaurant & Bar locations in the Pittsburgh area. As many as 16 workers were detained — nine worked at a location in Gibsonia, a suburb north of Pittsburgh, and seven others worked at another location in the nearby township of Cranberry.

 

In a social media post that same afternoon, which included a video taken by a worker, the business accused agents of storming into its restaurants and leaving “a trail of fear, confusion, and destruction” that included a burned kitchen, torn ceiling tiles, broken doors, a safe cut open by an agent and trashed food. The incident raises questions over the tactics used by authorities at this particular raid.

This week, gas plumbers fixed a stove that was damaged during the raid, according to two people working at the restaurant chain. Staffing was also thin at the locations targeted by immigration authorities as employees who witnessed the raid, including those who are U.S. citizens, remain “in shock,” they added. “No one wants to go back, everyone is scared.”

Both workers who spoke with NBC News requested to not be named to protect their family’s privacy because of an ongoing federal investigation in connection with last week’s events.

The U.S. Attorney’s Office for the Western District of Pennsylvania declined to clarify what the investigation it is leading is about.

As the immigration arrests were happening last week, someone alerted an emergency response immigration hotline run by Casa San Jose, a local nonprofit that advocates for Latino and immigrant communities.

The organization quickly dispatched about 20 volunteers to both locations to act as legal observers, collect testimonies and provide support to the workers and families affected, according to Jaime Martinez, a community defense organizer at Casa San Jose.

At the Gibsonia location, “the raid actually caused a kitchen fire that agents were unable to extinguish at the beginning, which put people in danger,” Martinez told NBC News on Tuesday.

Employees who spoke to Martinez and his volunteers said the stove was on when agents entered the kitchen because workers were cooking food as they prepared to open the restaurant Thursday morning. The restaurant’s manager warned agents that the open burners were on, but witnesses alleged that agents didn’t do anything until a fire sparked, he said.

The detained employees, who had their arms and ankles shackled, were the ones who directed the agents to find the fire extinguisher and instructed them on how to use it after initially failing to operate it, according to employees who spoke to Martinez and his volunteers.

“By the time the fire department got there, the fire had already been put out with a dry chemical extinguisher, but only after this delay,” Martinez said.

A spokesperson with U.S. Immigration and Customs Enforcement told NBC News in an email Thursday that the “damage to the restaurant, including the small fire, was created by the illegal aliens themselves while they were trying to escape or hide from law enforcement officers.”

According to ICE, the agents showed up at the locations in Gibsonia and Cranberry to execute federal search warrants based on information it got alleging that the restaurants were employing undocumented workers, WPXI, NBC’s affiliate in Pittsburgh, reported. The agency added that the 16 people detained lack legal status and are now in ICE custody, undergoing immigration proceedings.

“But in the process of coming in with that warrant, they also terrorized the community, pointed guns at people and destroyed a local business,” Martinez said.

In response to this, the ICE spokesperson told NBC News, “All agents and officers followed established legal procedures while executing the warrants.”

At the Cranberry location, Casa San Jose volunteers interviewed a worker who described seeing officers come into the restaurant, shouting “police” and pointing their long guns at the employees. One female employee who was in the kitchen said an agent “pointed the gun at her head” while telling her to stop cooking, according to Martinez.

While she was not detained after showing proper documentation, “this lady is now going to have to live with the trauma of having law enforcement point a gun at her head while she was at work,” Martinez said.

Martinez and one of the workers who spoke with NBC News said agents lined up all of the cuffed employees and made them kneel while pointing their weapons at them.

“Agents and officers operated within established law enforcement standards in order to ensure the safety of law enforcement officers, the public and the illegal aliens themselves,” the ICE spokesperson said in response to this allegation.

Last week was not the first time immigration authorities attempted to detain employees from Emiliano’s Mexican Restaurant & Bar. The ICE spokesperson confirmed to NBC News that a June incident was part of “an investigation that ultimately led to the execution of the warrants” this month.

Martinez said that on a night in June, he got a call on the hotline, reporting unmarked vehicles surrounding a nearby apartment complex. When the volunteer who was dispatched arrived at the area, she noticed the vehicles were parked with their engines still running, in front and behind the restaurant.

According to Martinez, it looked like federal agents inside the vehicles were waiting for workers to come out of the restaurant as it was closing. The vehicles left once TV crews arrived on the scene, he said.

“There were nine people in that restaurant on lockdown,” Martinez said, adding his group doesn’t know the immigration status of those workers since it doesn’t ask people about that as part of its policy. “But you don’t have to be undocumented to be afraid of getting detained.”

Since launching the hotline in March, Casa San Jose has received more than 650 calls reporting more than 100 immigration detentions in the area and has dispatched volunteers in at least 70 instances, according to Martinez.

In the wake of the raids at Emiliano’s Mexican Restaurant and Bar locations, the community came together and collectively donated more than $133,000. The workers who spoke with NBC News said the business plans to use the funds to cover bond expenses, one month worth of salary for each employee detained and repair damage done to the restaurant.

With the neverending firehose of incredibly disappointing information, it’s easy to assume that everything is garbage and everything sucks all of the time. Yesterday, I yelled “Well, fuck Costco!” after reading a Reuters article titled “Costco to stop selling abortion pill mifepristone at its US pharmacy stores” — because that’s some bullshit, right?

Well, it was, just not in the way you might immediately assume. Costco never actually sold mifepristone, so they couldn’t “stop” selling something they never sold to begin with.

Stories later in the day did get it right (our link is to the archived very wrong version!). Costco had apparently been deliberating on whether or not to sell abortion medication at their pharmacies (it requires a certification to be able to carry it), and decided against.

Reuters and several other sources noted that the move came after “pressure” from anti-abortion groups, as well as Southern Poverty Law Center-designated hate groups like Alliance Defending Freedom, which even went so far as to issue an utterly insipid victory statement.

“We applaud Costco for doing the right thing by its shareholders and resisting activist calls to sell abortion drugs. Retailers like Costco keep their doors open by selling a lifetime of purchases to families, both large and small. They have nothing to gain and much to lose by becoming abortion dispensaries. Retail pharmacies exist to serve the health and wellness of their customers, but abortion drugs like mifepristone undermine that mission by putting women’s health at risk,” said Michael Ross, the group’s legal counsel.

For the record, mifepristone has an extremely low rate — 1 percent — of complications. It is more safe than Viagra or even Tylenol. Abortion is not the only use for the drug, either. It is also used to help safely expel a miscarriage so that one does not become septic (and perhaps require penicillin … yet another drug that is less safe than mifepristone). Groups like the ADF think that if they just keep confidently repeating blatant lies about abortion medication like they are universally accepted as true, that everyone will just go along with them. Just like maybe they’ll believe that the ADF and other groups are so influential that they actually did successfully push Costco to refuse to sell mifepristone.

But there is no reason to believe, without evidence, that Costco’s decision actually had anything to do with “bending the knee” to them or any other insane religious organizations dedicated to making life hell for women, LGBTQ+ people, and anyone who doesn’t share their religious beliefs.

Why? Because the company has no history of doing that, at all, for any reason. In fact, the company has notably refused to “bend the knee” to Republican Attorneys General and whiny conservatives across the land who have been demanding they ditch their DEI policies.

“If these are the policies you see as offensive, I must tell you I am not prepared to change,” CEO Richard Vachris wrote to a “concerned” customer who emailed him, upset about the company’s DEI policies and demanding to know if the company was hiring people based on “skin color” or “gender identification.”

“Attacks on DEI aren’t just bad for business — they hurt our economy. A diverse workforce drives innovation, expands markets, and fuels growth,” Costco board member Jeff Raikes wrote on social media.

Why would a company willing to risk the ire of these groups in that way suddenly decide to capitulate to them in another?

While it’s certainly disappointing that they didn’t change their policy of not selling mife, and those of us with Costco memberships should let them know that, the company has not said that this decision had anything at all to do with wanting to put a smile on the faces of the bigots at the ADF.

Rather, they said they didn’t think there was a demand for it.

“Our position at this time not to sell mifepristone, which has not changed, is based on the lack of demand from our members and other patients, who we understand generally have the drug dispensed by their medical providers,” Costco said in a statement. It’s not what we want to hear, obviously, but it doesn’t necessarily mean that they did this because of pressure from the Right.

It’s also worth noting that Costco is known to treat their workers well, paying them, on average $31 an hour with good benefits — quite a bit higher than many of their competitors.

They also have a strong history of not being shitty in this way.

It would be a mistake to roll over on one of the few companies out there that isn’t completely evil. In addition, we shouldn’t hand groups like ADF an unearned “win,” which they have made clear they want to use to pressure other companies — including CVS and Walgreens, which are certified to dispense mifepristone — to stop selling abortion medication, as well as to make the rest of us feel that they are winning the culture war.

It’s like when the One Million Moms (one mom) take credit for getting TV shows canceled or commercials pulled off the air when those decisions actually had nothing to do with them at all. Claiming victory, for these groups, is a way for them to rally their base and to make other companies think they have more influence than they actually do.

The majority of Americans believe that abortion should be legal, and they’ve demonstrated this by voting in favor of keeping it legal in their states at practically every turn (not in Florida, because Florida requires 60 percent of the population to approve a ballot measure, which is some bullshit).

If Costco thinks there isn’t enough demand for mifepristone (which, yes, is a weird thing to say because it’s not like a medication anyone gets on a regular basis), then we should convince them that there is, by encouraging them to change their mind and get the certification necessary to sell abortion medication. Minnesota teen says server forced her to prove her gender in restaurant bathroom

As I keep repeating these bathroom bills hurt cis women because it is based solely on how someone looks to some other people.  If as in this case a cis woman did not look feminine enough for the server and so this woman was forced to show her breasts.  How is that feminism work going TERF people.  These bathroom bills and the hype of fake false stories of danger to women only make all women less safe.  See now people that look like men legally might have to use a female’s bathroom, so all a cis man has to say is he is trans and they can legally be in the woman’s bathroom.  Same for any female that wants to go into the men’s room only needs to claim to be a trams women.  All due to hate and bigotry making a problem where none existed.   Think of it, the only assaults I have heard about in female restrooms is from cis people attacking cis females because they think they are trans.   Hugs

The 18-year-old high school student said she unzipped her hoodie to show she had breasts after a Buffalo Wild Wings server didn’t believe she is a woman.

A Minnesota teenager filed a charge of discrimination against a Buffalo Wild Wings restaurant Tuesday, alleging a server followed her into the women’s restroom and demanded she “prove” she was a girl.

Gerika Mudra, 18, went to dinner in April with a friend in Owatonna, about an hour south of Minneapolis. When she went to the restroom, a server followed her inside and banged on the stall door while saying: “This is a women’s restroom. The man needs to get out of here,” according to Gender Justice, a Minnesota gender-equality organization that filed the charge on Mudra’s behalf.

Mudra, a biracial lesbian who isn’t transgender, said that she has been in similar situations before, when people have suggested she’s in the wrong restroom, but that when she tells them she’s a woman they leave her alone. However, when she came out of the stall at Buffalo Wild Wings and told the server, “I am a lady,” she said, the server responded, “You have to get out now,” Gender Justice said in a statement.

Mudra said she felt she had to prove to the server that she is a woman, so she unzipped her hoodie to show she has breasts. The server didn’t say anything in response but left the restroom, Mudra said.

“She made me feel very uncomfortable,” Mudra said. “After that, I just don’t like going in public bathrooms. I just hold it in. … I want to be able to use the bathroom in peace.”

Inspire Brands, which represents Buffalo Wild Wings, didn’t immediately respond to a request for comment.

Gender Justice filed the charge of discrimination with the Minnesota Department of Human Rights, arguing that what happened to Mudra violates the state’s Human Rights Act, which protects people from discrimination based on gender identity and sexual orientation, among other protected statuses.

Sara Jane Baldwin, senior staff attorney at Gender Justice, said at a news conference Tuesday that even though Mudra isn’t trans, the server’s actions “were based on assumptions that she made about” Mudra, and that Minnesota’s law protects against discrimination based on stereotypes or assumptions about protected characteristics like gender identity.

“Businesses have a legal obligation not to just have antidiscrimination policies on paper, but to train staff and ensure that those policies are followed in real time,” Baldwin said. “When that doesn’t happen, the business is liable for the harm caused.”

Gender Justice said Mudra’s experience “reflects a broader climate of fear and suspicion aimed at anyone who doesn’t conform to narrow expectations of what girls and women ‘should’ look like.” That suspicion has been driven largely by the wave of state legislation targeting trans people, particularly their access to school sports and bathrooms that align with their gender identities, though Minnesota hasn’t enacted any such legislation.

Nineteen states have laws that prohibit trans people from using bathrooms that align with their gender identities in K-12 schools, and in many of those states the restrictions apply to other government-owned buildings, as well, according to the Movement Advancement Project, an LGBTQ think tank. Twenty-seven states prohibit trans people from playing on school sports teams that align with their gender identities.

Even before such laws, trans people had long reported facing harassment in public restrooms and avoided using them as a result. There have been several reports this year of women who aren’t transgender alleging harassment in public restrooms because they were suspected of being trans, including at the U.S. Capitol in JanuaryPhoenix in FebruaryFlorida in March and Boston in May.

“This kind of gender policing is, unfortunately, nothing new,” Megan Peterson, executive director at Gender Justice, said in a statement. “And yet, in our current climate we have to ask: What if Gerika had been a trans person? Would this story have ended differently? That’s the terrifying reality too many trans people live with every day.”

Even if Mudra had been trans, she would be able to file a discrimination complaint under state law in Minnesota, which is one of 21 states and Washington, D.C., that explicitly prohibit discrimination based on sexual orientation and gender identity in public accommodations, according to the Movement Advancement Project. Two states explicitly prohibit discrimination based on sexual orientation only, and six additional states interpret existing measures against discrimination based on sex to also include discrimination based on sexual orientation and gender identity. Twenty-one states don’t have explicit protections from discrimination based on gender identity in public accommodations.

The last time Trump and Putin held a summit, the two “presidents” met privately with only their translators present. Trump had a Russian translator, and Putin had one who could translate English and Word Salad. After the private confab, Trump took the translators’ notes, and some say he ate them, which is why he always travels with ketchup. Then they held a joint press conference where Putin didn’t have to deny that he meddled in the 2016 election, because Trump did it for him. During the summit, Putin gave Trump a soccer ball to give to his son and future serial killer, Barron, and Trump gave Putin his balls.

The International Criminal Court issued an arrest warrant for Putin in 2023 for war crimes, but just like Benjamin Netanyahu, he’ll visit the United States without any worries of Trump arresting him. Trump is too busy arresting black teenagers in the District anyway.

The major issue in this summit is ending the war, or at least obtaining a ceasefire between Russia and Ukraine, but they’re doing this without the involvement of Ukrainian president Volodymyr Zelensky. Trump has done this before, making a deal with the Taliban for the US withdrawal from Afghanistan, without involving the government of that nation at the time. Don’t expect a peace deal to come out of this.

Maybe on the side, they’ll negotiate a new Trump Tower for Moscow. I mean, Trump negotiated business deals with Saudi Arabia, Qatar, and the UAE last time he was in the Middle East. Now I think that’s really going to happen. Maybe Putin will give him a used plane nobody else wants.

What will come out of it will be Donald Trump appeasing Putin and further embarrassing the United States in front of the world. Trump has already embarrassed us by choosing Alaska for the summit.

The US bought Alaska from Russia in 1867, which Russia has regretted ever since. Holding the summit in who-knows-where in Alaska gives Putin a nod that borders can change and land can be bought, sold, and conquered. Will Putin ask Trump to give Alaska back? Maybe he’ll convince TACO that it would be a historic deal. Or maybe Trump will trade Alaska for an Eskimo pie.

And no, we don’t know where in Alaska this summit is going to be planned. Will it be in Fairbanks, Juneau, or Anchorage? If it’s held in Sitka, it’ll be a huge gift to Putin, as that city was where the ceremony was held for Russia’s transfer of Alaska to America. Now, I think it’s going to be held in Sitka.
