‘ICE is not a law unto itself’ | Judge says ICE has violated nearly 100 court orders this month

There is a video at the link below.  But when the law breaks the law is there a rule of law?  In nearly 100 court cases ICE just ignores the rulings against them.  But nothing changes, no contempt.  Do you think you could just ignore the orders of a court?  But ICE and DHS / tRump admin have been doing this since they were told during the Cecot issue to just say fuck you to the courts.  Total dictatorship authoritarian rule.  The only recourse the people have is the US court system and the republican right along with Stephen Miller  say to their thugs, Ignore court rulings you don’t like as they restrict your the civilian’s personal civil rights / liberties. In a court order, Judge Patrick Schiltz wrote that 96 court orders were violated in 74 cases.

MINNEAPOLIS — In a court order, Minnesota’s chief judge wrote that the U.S. Immigration and Customs Enforcement (ICE) has violated nearly 100 court orders this month. 

Judge Patrick Schiltz filed a court order Wednesday, canceling Acting Director of ICE Todd Lyons’s Thursday hearing. In the order, Schiltz provided a list of 96 court orders that he says were violated in 74 cases.

“The extent of ICE’s noncompliance is almost certainly substantially understated, ” the order reads. “This list is confined to orders issued since January 1, 2026, and the list was hurriedly compiled by extraordinarily busy judges. Undoubtedly, mistakes were made, and orders that should have appeared on this list were omitted.”

Lyons was scheduled to appear in court to face contempt charges after he failed to provide a bond hearing for a man who was detained. Schiltz, who was appointed by George W. Bush in 2006, ordered Lyons to testify unless the man was released. The man was released late Tuesday, and the hearing was canceled.

Schiltz wrote, however, that it didn’t end the court’s concerns.

“This list should give pause to anyone—no matter his or her political beliefs—who cares about the rule of law,” Schiltz’s order reads. “ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence.”

He continued: “The Court warns ICE that future noncompliance with court orders may result in future show‐cause orders requiring the personal appearances of Lyons or other government officials. ICE is not a law unto itself.  ICE has every right to challenge the orders of this Court, but, like any litigant, ICE must follow those orders unless and until they are overturned or vacated.”

  1. I saw this story the other day. It ought to sober everyone, I’d think. And, yes, there was one contempt citation heard and one detainee released, in this story, but the judge is using the areas he can to tell people that Congress needs to act on all these things.

    A judge can’t call a hearing for contempt. The prosecuting, or the proponent’s side in a civil case has to file for contempt proceedings.

    I’m going to look for the Amanpour & Co. I watched today during commercial breaks of “Young & The Restless” while I did my morning jog. Everywhere, people are calling for the Congress to act, and with assertion.

    1. Hi Ali. A judge can act on their own if they wish. It is called “sua sponte,” which is a Latin term meaning “of its own accord.” This refers to actions taken by a judge without a request from either party involved in a case. That is sort of what this judge did. Yes they are calling on congress to act, and congress is … not responding very well are they? Barely registering any republican disent and democrats members are on media but not leadership. Schumer misses every chance to hammer the tRump admin, and Jeffries is too busy playing with big money donors. Jeffries let 7 democrats vote for the spending bill. What kind of leadership is that for messaging? Schumer did the big shutdown cave as well. The people have shown support for a lot of things congress ignores, they are ignoring this as well. IMO.       1. Well, it must vary by state, then. My understanding given by lawyers and experience is that, while, judges may do things during public hearings and trials, they cannot simply call a hearing on their own. They do set the dates, though! 🙂 Very important.
        Schumer’s been around. I guess not where you read and listen, though. I’m not sticking up for him, I’m just saying, he’s been around. And it’s important to go to congress.gov to see precisely what was voted upon and passed. Not many people do that, anymore, but it’s important.

        1. Hi Ali. No I am serious, it is what I said. I had to look up the latin term as I couldn’t spell it. I learned it from listening to Allison Gill and her many podcasts about the courts and this administration. Please look it up, it is real that courts can do this. Most rarely do unless pushed but now they are being pushed. I got the spelling from wikipedia. It really is a thing.

          Ali on Schumer you see what I post. I stopped doing podcasters so much and went to the major corporate media due to your criticisms I was posting people talking who had no credentials. I watched them but found them less informative as they have to watch the corporate bottom line, but even so I started posting them. Again, no leadership with all the minor democrats who were on screen. We have an entire leadership team in their late 70s like Dick Durbin who never go on media.

          As for going to a government web site to see what our democratic leaders are doing … That is not realistic. Most people are not us, they have only the drive time between jobs or a short period of downtime when they can watch / see politicians. They are not going to go look up a web site of dry written facts. They want media they can watch or listen to while doing other things … like me. You have told me you prefer written stuff over verbal / visual media stuff but that is not what most people want. As you say not many do that anymore, because just trying to make a living and dealing with life keeps them from doing that. Which leads me to the next point below.

          Right wing media took over with Rush Limbaugh. A total hypocrite bigot. But he was on radio in a time when people listened to radio on their way to and from work, also on their off time. I worked nights and while doing stuff around the house I hate listened to him. The left’s alternative was Larry King but he simply stopped leaving the right wing hate media an open field. After that the right learned their lesson and went in with all they had. It changed our entire society.

          That is why I keep saying that the democrats need to get on media, podcast media, and mainstream media. For example, Pete Buttigieg often goes on fox and kicks their ass. We need to do what the republicans do, they are out there shouting stupid hateful stuff and their base loves it. We have to counter that. Ali as you know my second conputer / moniter is constantly streaming political news. I do not see our leadership there and when I do it is so milquetoast it is like a small schoolboy trying to pretend the bullies that told him they would beat him up after school don’t scare him to his friends.
